Speaking Of Privacy, What About ObamaCare ?

By David King Published: June 18, 2013

I'm happy that my friends on the left side of the aisle see the problem with the government collecting the phone records of all Americans, as revealed by NSA leaker Edward Snowden. I see the problem too. The government has no right to invade the privacy of innocent American citizens without cause, as is stated in the Fourth Amendment.

Using the same privacy reasoning, I have to ask my left aisle friends why they supported ObamaCare, which handed over all our medical records to the government.

Why is the government entitled to our medical records (according to Democrats), but not to our phone call records ? It doesn't make much sense to me.

The privacy issue is almost exactly the same, except that with our medical records there is no "we're trying to uncover terrorists" reasoning. The reasoning ObamaCare used to invade the privacy of our medical records was far more flimsy. It involved no credible threat to the country. It involved no criminal activity. Yet Democrats and liberals went along with this invasion of our privacy almost to a man, despite the complete lack of probable cause of anything. It makes me wonder why they object to the NSA collection of phone records at all.

Under ObamaCare, the government will collect your medical records electronically. It will also collect your medical records via your ObamaCare application. Once the government has that information, it will certainly use it.  It already is using it. Now under ObamaCare, the government will share your personal medical records. From The Washington Times:

A new 253-page Obamacare rule issued late Friday requires state, federal and local agencies as well as health insurers to swap the protected personal health information of anybody seeking to join the new health care program that will be enforced by the Internal Revenue Service.

Protected health information, or PHI, is highly protected under federal law, but the latest ruling from the Department of Health and Human Services allows agencies to trade the information to verify that Obamacare applicants are getting the minimum amount of health insurance coverage they need from the health "exchanges."

The government, of course, says it will obey privacy laws with regards to our medical records, just like it is says about collecting our phone records. President Obama even went full Orwellian Newspeak yesterday and said the government phone collection programs were "transparent". The NSA secretly collects all our data and obtains authorization from a secret FISA court, and Obama calls that transparent. In related news, Obama has proclaimed that night shall now be called day. Maybe Obama thinks transparency means that Obama knows what Obama is up to, though even that seems to be a rare occurence (He didn't know anything about Fast And Furious, Benghazi, IRS targeting, etc).

With your private medical records flying around on various government computers, and the government feeling entitled to your private information, what could possibly go wrong ? Maybe a lot more of this type of activity:

A class action lawsuit filed in California in March claims that in the course of serving a warrant for tax records related to a single former employee of a southern California business, IRS agents “stole more than 60,000,000 medical records of more than 10,000,000 Americans.” The agents did this in spite of the fact that such a seizure was not authorized by the warrant, was irrelevant to their investigation, and violated federal law, the suit says.

I guess targeting Tea Party groups, leaking tax information for political purposes, and leaking donor lists for political purposes isn't enough for the IRS.

Now we're about to give the government access to all our medical records too, brought to you courtesy of the Democratic party. In the next presidential election, I predict we'll start hearing about how Marco Rubio had the crabs when he was a teenager, or about how Hillary started buying birth control pills when she was fourteen. I know I can't wait for Herpesgate, or to see Chris Christie's colonscopy video on YouTube. I can hear the debate questions already..."Rep. Ryan, you have released your tax records, but why haven't you released your detailed sexual history to dispel the speculation about where you got that rash in 2007 ?".

This is my major problem with liberals, er, I mean progressives. They complain about Big Brother once in a while (oddly, it's mostly when the government is fighting criminal activity or enemies of the USA), but the rest of the time they want to give Big Brother ever more power, and the liberal endgame would leave us as little more than pawns being pushed around the grand chessboard of the government elites. I don't get it.

Obamacare’s start date, January 1, 2014, has not even passed and we already have a major breach in security for 10 million Americans over their medical records.  And the culprit is none other than our own IRS. The same IRS that has been targeting tea parties and which has been put in charge of policing the ACA.  Could it be that the IRS is taking their new health care enforcement role a little too seriously?

Courthouse News reports that the John Doe Company of California has sued 15 IRS agents in Superior Court for seizing 60,000,000 medical records of 10,000,000 Americans.  In 2011, the IRS agents raided the company over a tax issue connected to a single former employee, but used the opportunity to appropriate the medical records of millions of innocent Americans who to this day do not know that their medical privacy has been violated.

“No search warrant authorized the seizure of these records; no subpoena authorized the seizure of these records; none of the 10,000,000 Americans were under any kind of known criminal or civil investigation and their medical records had no relevance whatsoever to the IRS search.”

The lawsuit emphasizes the sensitive nature of the records explaining that they include “information about treatment for any kind of medical concern, including psychological counseling, gynecological counseling, sexual or drug treatment, and a wide range of medical matters covering the most intimate and private of concerns.”
