Judge in Akron allows pipeline work to continue

U.S. District Judge John Adams today ruled that work can continue in a pipeline in Carroll County.

Adams dissolved a temporary restraining order issued two weeks ago, in the lawsuit filed by landowner Joseph Coniglio, the Youngstown-based Business Journal reported.

Adams' ruling allows CBC Services Inc. to continue with connecting 1,000 feet of pipeline to a well on land owned by Coniglio.

On July 8, Coniglio filed suit against CBC in Carroll County and was granted a TRO.

The case was later moved to federal court in Akron.

The central issue is whether Chesapeake Energy Corp. has the right to connect the pipeline to the well absent a separate pipeline agreement.

Coniglio had signed a well-drilling agreement but Coniglio says that does not provide for pipeline construction.
