Youngtown dumping may exceed 252,000 gallons, state says

By Bob Downing Published: February 12, 2013

Ben Lupo, owner of Youngstown's D&L Energy and Hardrock Exacavating, told the Ohio Environmental Protection Agency that he ordered employees at least six times to dump drilling wastes from 21,000-gallon tanks to storm sewers that drained to the Mahoning River.

That activity from September 2012 to Jan. 31, 2013, means that at least 252,000 gallons of drilling wastes were dumped, the Youngstown Vindicator reports.

The state of Ohio is investigating criminal and civil lawsuits against Lupo.

The operating permits of his two companiesin Ohio have been permanently suspended by the state.
