19-year-old charged in Akron teen's killing to testify against alleged shooter, could serve 13-year term

Two of three men charged in the December shooting death of Jeffrey Gardner, 17, of Akron, have now pleaded guilty to involuntary manslaughter.

In a plea deal reached Friday with Summit County prosecutors, Jeffrey Coffey Jr., 19, pleaded guilty to involuntary manslaughter and aggravated robbery.

Under the deal, Coffey agreed to testify against co-defendant Ty L. Mitchell, 21.

Prosecutors say Mitchell shot Gardner on Dec. 17 after Coffey, Mitchell and 18-year-old Justin M. Georgakopoulos broke into an apartment in the 600 block of Grant Street.

Georgakopoulos reached a plea deal in April. He will be sentenced to prison for 16 years for manslaughter, aggravated robbery and a weapons charge.

Prosecutors said Coffey will serve a 13-year prison term if he testifies truthfully, but if he fails to do so, they would recommend he serve a 23-year sentence.

Summit County Common Pleas Judge Robert Gippin delayed sentencing until Mitchell's case is resolved.

Mitchell was also in Gippin's courtroom Friday for a suppression hearing. His attorney, Joe Gorman, is seeking to have Mitchell's taped interview with two Akron police detectives thrown out.

On the tape, Mitchell denies any involvement in the killing or being present when the killing occurred.

Gorman is arguing that detectives violated Mitchell's Miranda rights. Gorman said that Mitchell, on at least six occasions, requested to end the interview. Detectives ignored his request, Gorman said.
