A jury trial began today in Summit County Probate Court on the University of Akron's efforts to use eminent domain to acquire property from Joe and Mona Nemer.
The Nemers own the Sun Bar and Grille and other parcels at the corner of East Exchange and Spicer streets in Akron that the university wants to acquire to build a residence hall.
The Nemers have rejected the university's offer of $1.038 million for their property, according to documents provided by the university.
They and relatives Manny and Colette Nemer, who also own land on East Exchange Street, have resisted selling their property since UA filed its original complaint in October. The two couples are the only property owners still fighting the university over eminent domain.
UA has acquired about 100 parcels for its football stadium, now under construction, and a nearby residence hall. The stadium is expected to be ready by fall 2009. The opening of the residence hall has been pushed back to December 2009.
The Nemers' trial is expected to take three days. A similar trial for Manny and Colette Nemer is scheduled to begin on June 16.
