Summit judge seeks appropriate treatment program for Barberton woman

A Barberton woman who has served 14 months of a two-year prison sentence for sexual battery could be granted early release next month after a judge decides on an appropriate sex-offender treatment program.
The woman, 44, who is being held in the Summit County Jail, appeared before Common Pleas Judge Paul J. Gallagher Monday morning for a hearing on her release, but the judge said he will need more time to find a counseling program offering intensive sex-offender treatment.
Gallagher scheduled the next hearing for 10 a.m. Nov. 10.
In July 2007, the woman pleaded guilty to one count of sexual battery for an ongoing relationship with a minor, who was 13 years old when the relationship began. The victim was her stepson, according to court records, and they had two children from the relationship.
Assistant Summit County Prosecutor Beth Aronson, the victim's mother and an aunt addressed Gallagher and opposed any form of early release.
''Please get this woman some help,'' the victim's mother said in a brief, tearful statement. ''She has ruined three lives: my son's and my two grandchildren that I have just now begun to know.
''I don't even know where to begin. She needs help. Please keep her where she's at and get her some help.''
The defendant's name is not being used because of a Beacon Journal policy of not identifying victims of sexual assault.
The aunt said the two children are now 9 and 11, and the victim is 27.
''We come from a very large and extended family, all of whom love and support [the victim],'' the aunt said. ''It has been devastating to us to see the effect this has had on him and those two [children].''
After hearing from the family and defense lawyer Joseph F. Gorman, Gallagher said he felt early release was appropriate provided the woman receives intensive psychological treatment.
It appeared the woman was going to be sent to a treatment program in the county's Community Based Correctional Facility, but when the prosecutor informed Gallagher that the facility is not permitted under Ohio law to accept Tier 3 sex offenders, the judge said he would need about two more weeks to find an appropriate program.
As part of the woman's sentence, she was placed in the state's most serious sex offender classification. A Tier 3 offender must register an address with authorities every 90 days for life, prosecutors said.

The highest tier sexual offender is only serving 14 months? What is this world coming to when a crime this serious leads to only 14 months in prison? I can only hope Gallagher doesn't get some sort of capital crime case where we spank a poor murderer and send him home after a couple years.

I can see why she only served 14 months - she needs treatment, not incarceration. Talk about scraping for charges here. What BS.
If the victum is 27 years old ,why didn't he speak up and tell the judge how devastated he was?Most importantly if the children were negatively affected,It had to be the family which inappropreitely told the 9 and 11 year the story.Who in their right min would tell such young children such a story and why?
This kind of stuff is commonplace in Barbertucky. Half of the city has someone they call Aunt Momma. I don't understand why they are making such a big deal out this one,and turning a blind eye to all the rest.
She needs to sit her pedophile ass down and do her time , what makes her crime any different from any other pathological freak?She's a sex offender.If the shoe were on the other foot,it's clear that the result would be totally different.

I'm curious how the kid's life is "ruined". He can no longer pursue a career? He can't own property?
It's not like he was sodomized by a dude at gun point; most 14 year old boys pray for sex, especially if your dad's new wife is hot. This is like saying he got into the liquor cabinet or took a car for a joy ride and now he's a hopeless victim.... I'm sure he can pull himself together much better than his hysterical mother.

All I want to see is a little equity in sex offender legislation and sentencing. I hate double standards... AND I VOTE.
Talk about double standards. If this woman had received a longer sentence, she also would have received longer treatment. After all, her victims are living a life sentence, and who is paying for their therapy? The 27 year old victim should have appeared in court to speak on his behave. Or is something else going on?
Is she getting fattened up on our tax money the same way her pal Cooey did?
This is the same judge who just gave the serial rapist less than life in prison. Keep this in mind at election time!

If memory serves me right, Summit County was a DUMPING GROUND for the MENTALLY ILL. During the Reagan years, these huge institutions turned the mentally ill into the streets. Massillon Hospital, Western Reserve in Northern Summit County, Northfield 2 be exact, Apple Creek, just name a few. Women will have sex for $$ and un-protected sex. This could be Forrest Gump's daughter!
There has always been a discount in sentencing for being female in Summit County. Remember the coach who had an affair with an 18 yr old. He did 2 years in jail.
She will get out of jail early the sudo fight put up by sherrys office to keep her in jail is just for show. I thought lady justice (the lady with blind fold holding the scales of justice) is peeking under her blind fold. She is anti male just look around you. We have offices in government for womans health issues but non for men, 40% of the men charged with rape are falsely accused the list goes on and on. It is called misandry - the hatred of men.
We need to vote people out of office that give discounts for being a female. We need better prosecution, remember Clarence Elkins.
Vote the bad people out of government, take back our cities, counties and state.
These offenders are incurable and a imminent danger to children, WHAT ARE THEY THINKING?
As a society we should give them ALL the needle in the arm.
