Defense lawyers pulled Marquez B. Perry, 19, away from the podium microphone before he could finish speaking Wednesday at his packed Summit County sentencing hearing.
They had heard enough.
And the judge had heard enough.
Perry, who was convicted of two counts of aggravated murder for a New Year's Day double slaying in the East Market Street parking lot of an Akron strip club, apparently blew any chance of a merciful sentence by failing to own up to the crimes.
So instead of getting a sentence of 20 years to life for each offense — the lower end of the state's sentencing guidelines for aggravated murder — Perry was given consecutive 30-year terms by Common Pleas Judge Elinore Marsh Stormer.
Along with consecutive three-
year sentences for accompanying gun specifications, Perry must serve 66 years in prison before making his first appearance before the state parole board.
The victims, Scott E. Smith, 33, of Akron, and Perry's girlfriend, Tammy S. Dickey, 30, of Youngstown, were shot to death in a 1997 Chevrolet Blazer during a botched drug deal behind Lisa's Cabaret about 9:15 p.m. Jan. 1.
An alleged accomplice in the shootings — Kaqun Slocum, 18, also of Youngstown — was located by Akron detectives two weeks ago and was arrested by the U.S. Marshals Service Northern Ohio Violent Fugitive Task Force.
Slocum, who was 17 when the shootings occurred, was taken to the Summit County juvenile detention center.
Hours before Perry's sentencing, Juvenile Judge Linda Tucci Teodosio held a bind-over hearing in her court and transferred Slocum's case to the county's adult system.
Prosecutors said Slocum also is facing two counts of aggravated murder and will be arraigned in Common Pleas Court within a week.
Stormer, visibly angered by Perry's comments after hearing a series of emotionally charged victim impact statements from children and family of the two victims, told Perry she had been leaning toward a sentence on the lower end of the state guidelines, which would have given him a chance to redeem at least some of his life.
But when deputies escorted Perry to the podium in front of the judge's bench, he showed no remorse and failed to take any responsibility for the shootings.
He uttered only a few sentences before defense lawyers Jason Wells and Eddie Sipplen grabbed hold of his red jail jumpsuit and pulled him back from the microphone.
Afterward, Wells said he and Sipplen were surprised by what happened.
''Absolutely. We told him not to say much of anything, other than to express his condolences to the families and to say he was sorry for their loss. But he went ahead on his own,'' Wells said.
He said Perry was told that he could not afford to say much because of his appellate rights.
Stormer, Wells said, was angered by Perry's ''lack of any feelings toward the families, or lack of owning up to anything in this case, and she decided to go ahead and hammer him.''
In the days following Perry's arrest, police asked him for the identity of the fourth person in the Blazer. Instead of cooperating, Perry made up a name and the police were unable to locate Slocum for months.
However, when Perry took the stand in his trial earlier this month, prosecutors used his contact list from his cell-phone records to tie him to Slocum.
Family members and friends of Smith and Dickey filled the three benches in the public gallery for the victim impact statements.
When Smith's parents took the hands of his three children and escorted them to the front of the courtroom, many in the gallery openly wept as Damone Smith, 12, clutched a hand-written letter to Perry.
But the child was too overcome with emotion, and Assistant Summit County Prosecutor Becky Doherty had to read the letter for him.
It began: ''Dear Marquez. Why do you kill people? Why do you do drugs? I just want to know why.
''The person you killed for no reason, Scott E. Smith, that was my Dad. He was a man with three children. Why would you take him away from us? Why did you kill him?''
Perry showed no emotion as the letter ended with Damone saying he, his two sisters and their grandmother and grandfather were hurt the most.
The letter was signed: ''Sincerely, Damone Smith.''

Well, I suppose the upside to this event, is that the kids will have an opportunity to be raised in an atmosphere where the head of the household doesn't sell or do drugs for a livin'.
to bad they just can't take him out back and shoot him like a rabid dog.
He deserved a Cooey death needle, not life on the Ohio taxpayers dollar. These black h00dies should all be executed for what they do.

What gets me is that she was going to give him a light sentence until he spoke? There should never be a light sentence for these murdering thugs. This is how all of them feel. They don't care about human life at all. This moron just sealed his coffin.
Another sad story. The actions of this young man has ruined his life as well as the victims.
Barbara...what article did you read? Do you know how to read? The Judge was not going to give him a "light sentence." Statute mandates the minimum and maximum sentence that could be given.

Hey Jack...HUH! This article leads one to believe this kid was going to get the "lower end" sentence before he peaved the judge off. And for these judges, they should take notice that these cold blooded murderers are never sorry(regardless of how good at acting they are) they meant every bit of what they did, are always going to be a danger to society and should always get the maximum or death penalty.

Why are judges permitted to give "lighter" sentences in murder cases? The guy just murdered someone. There are no degrees of dead. So there are no degrees of their sentence. These judges need to hand out punishment that fits the crime. The old saying "an eye for an eye" should apply here. If you murder someone, you should die.

Beta, I know Damone Smith. Does not matter what his dad does for a living, its his dad. The boy is absoultly the calmest, nicest, and loving kid you will find. You comments are totally off the wall and uncalled for with a childs love for his dad.

I worked security for a short and I mean short amount of time.... got tired off dealing with scum. but out of the 78 people I caught only one was white. and he was the only one to say he was sorry for what he did. look into the facts that 28% of akron's population creates 82% of the violent crime in akron. that 28% is black. and judges like teodoseio think these thugs can be reformed and gives light sentances to them. get her out of office.
Why was he not put to death? He will be in his 80's so what is the point of letting him out then if he lives that long?
It is a shame that some people, in this day and age, still have such ignorant mentalities. Scott was one of the greatest men I ever knew, despite what he did on his own time. That does not constitute murdering him, nor trying to diminish his character. Regardless of the rash comments and uninformed insights, he was and always will be a great man. God Bless his family, I will always remember you guys.
I want to know what he said? That is some great reporting!!! They have a person that transcribes everything that is said in court unless the judges tells them to strike it from the records!!!
the kids DO have a wonderful mother, family, and father. Just because Scott is no longer with us physically, mentally and emotionally he is and will always be. As far as Tammy's family I don't know too much about them however my condolences go out to you all. We love and miss you Scott (Kooba)
