Fair value of property requested for dormitory goes before Judge Spicer

Starting today, the University of Akron and a Fairlawn couple will square off in court over the value of the couple's business property.
Summit County Probate Judge Willard Spicer will hold a motions hearing at 10 a.m. today. The trial is to begin at 9 a.m. Tuesday.
The university has been trying for more than a year to acquire Manny and Colette Nemer's property on East Exchange Street to expand a planned residence hall.
Manny Nemer says he wants to stay where he is to take advantage of the increased traffic to be generated by the UA stadium, now under construction nearby.
He also has said UA's offer is too low for the couple to relocate their businesses — Manny's Pub and Aroma Coffee and Tea — near the university.
UA has been buying land for the stadium and residence hall projects for years. Many property owners willingly sold their modest, turn-of-the-20th-century homes. Some business owners resisted.
One of the biggest disagreements was with Joe and Mona Nemer of Fairlawn, who owned property near Manny and Colette Nemer's on East Exchange and Spicer streets. Manny and Joe Nemer are cousins.
A probate court jury ordered the university to pay $2.1 million for the Sun Bar and Grill, rental homes and warehouse, and another $1 million for a parking lot Joe and Mona Nemer own jointly with Manny and Colette Nemer. The couples would have split the $1 million award for the parking lot.
The university said the total award of $3.1 million was too much and instead agreed to give Joe and Mona Nemer $2.1 mil
lion for moving expenses, attorney fees and their property, including their half of the parking lot. The amount to be paid for Manny and Colette's share of the parking lot remains in limbo.
The university also is awaiting the result of an investigation by the Ohio Ethics Commission over property purchased from the son of a UA trustee.
UA bought a rental home from Jack W. Morrison Jr., son of Trustee Jack Morrison, for $110,000. That represented a 40 percent increase in value in the the year the son owned it. The father did not vote on the purchase of the son's property.
The commission has forwarded its report to the Summit County prosecutor's office. Paul Nick, chief investigator of the commission, and Brad Gessner, spokesman for the prosecutor's office, declined to comment.
UA has delayed knocking down the Morrison house on Spicer Street pending the outcome of the investigation.

Handcuffed that is funny. I didn't catch it as I know where Aroma is on East Exchange. I used to go there in the 90's to meet friends from college.
Interesting about the Morrison property. I don't think the Ethics Commission refers anything to the prosecutor's office unless there is something there.

This shouldn't be an issue for Akron U. Negotiate a comparable price, as that receieved by the other Nemer, and then be done with it.
Akron U has the money and has demonstrated that they will spend it lavishly, as demonstrated by the extra paid days off for employees, while announcin' the financial health of the college.
Read Sundays PD about Russo, Dimora and Plusquellic and the Mafia connection. Beacon won't print it.
UA needs to pay the 3.1 million, and pass the cost on to the students like they also do. I am gald the Nemer are standing up for their rights, and not allowing UA to scam them.
The Nemmer's are trying to scam...the property isn't worth that much. Take the offer and run...

Why do the residents of this city refuse to recognize it? Would you rather have urban blight or a well-compensated business owner and beautiful new development? And don't tell me $2.1 million wasn't FAR more than was deserved for that dump on the corner...
Good comment Justin...just complainers here...no one with any real solutions...not that I have a solution, but I would prefer being part of it (the solution) than not.
Robert says that the BJ will not print a story which he read in the PD, a story which mentions some donations to the Plusquellic campaign fund by so-called Mafia guys. The PD story was written by PD reporters, and, tho I am not sure, I think that the story is not available to the Beacon.

Glenda do even know what your talking about. Those pieces of property are junk. Your probably not a property owner, because if you were you would know the value of property is down. I don't even know why this article is back in the paper.

Agreed the properties are junks and toilets and anyone defending the Nemers hasn't been there in years. The dump properties were rundown long before the stadium construction started. Manny actually wasn't the owner and Summit County tax records drive that home. He got the properties back once he got wind UofA was building the Stadium and dorm complex. He wants big monies for his dumps plain and simple and is grandstanding about wanting to stay. He hasn't pumped monies into those dives in years and Manny's pub was minus bathroom doors. This greed and getting far more then his toilets are worth.
Justin, to answer your question as to why people don't get that UA is a gem for Akron: It's because Akron is filled with provincial, anti-education hillbillies who think they are groovy hippies like Glenda.
Christine, you went to Aroma in the 90s and not the 90's.
Glenda also needs to catch up. The issue with Joe Nemer is over. UA paid 2.1 million and not 3.1 million. End of the discussion there. Next up is phony, dishonest Manny and his day in court where he and his wife will try to swindle UA, its students and the tax payers of Ohio.
I predict he'll lose just like his greedy cousin, Joe did. Down with the Nemers and up with The University of Akron - this city's and region's greatest asset.
For the record Joe Nemer got 1.3 mil. 800,000 of the 2.1 mil is lawyer fees and costs the UofA paid. Joe got 1.3 mil which he could have gotten from UofA had he negoiated in good faith. Manny appears to have not learned from his cousin and Spicer has already ruled that he can't use the real estate broker who grossly over estimated the value of Joe's toilet properties. IMO, the results should be more in line with the actual value this time around.
