Neighbor arrested over ball files lawsuit

88-year-old woman says her health suffered

By Associated Press

BLUE ASH: An 89-year-old Cincinnati-area woman arrested for confiscating the neighbor child's football is now suing the boy's parents.

Edna Jester filed a lawsuit in Hamilton County Common Pleas Court claiming she has suffered emotional distress because footballs and other playthings belonging to her next-door neighbors keep landing in her yard, The Cincinnati Enquirer reported.

In October, Jester refused to return a football, was taken to the Blue Ash police station and charged with petty theft. The prosecutor later dropped the case.

The lawsuit against parents Paul and Kelly Tanis seeks unspecified monetary damages.

Kelly Tanis calls the suit "very silly" but says she and her husband also worry because they have five children and can't afford a lawyer.

"Kelly Tanis calls the suit "very silly" but says she and her husband also worry because they have five children and can't afford a lawyer."

I don't think the suit is silly. Your children have tormented a 89 year old woman! I hope she wins!

YOU WOULDN'T HAVE TO WORRY IF YOU AND YOUR CHILDREN WOULD'VE JUST RESPECTED THE 89 YEAR OLD NEIGHBOR, AND KEPT YOUR BALLS OUT OF HER YARD. AND I CAN HONESTLY SAY I DON'T BLAME HER - THE PRICE OF A FOOTBALL COMPARED TO THE PRICE OF A BROKEN WINDOW OR SIDING. OR HEART ATTACK BECAUSE IT BOUNCES OF THE WINDOW NEXT TO HER AND SCARES HER TO DEATH. CANNOT AFFORD A LAWYER - TRY FIXING A WINDOW OR SIDING.

this lady is stuck on stupid for filing the lawsuit. at her age, she should worry about staying alive instead of kids having fun. there should be a list of jerkoff attorney's that file this type of suit. it obvious the attorney will be the only money winner in this, and that sucks. publish the attorney's names who file stupid lawsuits with their picture on april fools day.

Emotional distress? How pathetic! Get over it Edna!

Sad how the world works today. The kids should have volunteered to do some yard work in trade for the 'distress' of having to have kids live next door. And certainly the police should never have arrested her.

It sounds to me like we are not getting the whole story. I am sure the kids have harassed this lady a lot more than just throwing stuff in her yard. She has a right to her property. They could be ruining her lawn and flower beds. We had a neighbor like that when I was a kid, and once she complained, we just got worse. It seemed funny then, but not now.

Seems to me this is small claims type of stuff. Why in God's name would those people need a lawyer? Even if they lose the case, it would only be about $500 max. Anything above that would be misjustice.

I'm sure that the stupid cop arrested her because she said something that affected his ego.

Why can't cops just do their jobs w/o getting emotional.

Please tell me that this township has more to do, than to arrest an 89 year old lady?

How about this Miss Edna? Call the police each time one of the lil brats TRESPASSES in your yard.

I'm not sure if you have family, but you wouldn't have this problem, if I was you granddaughter.
