A man convicted of nearly beating Jill Marker to death in a North Carolina floral shop in 1995 will not get a new trial.

Kalvin Michael Smith, who was convicted in 1997 of savagely beating a then-pregnant Springfield Township native, leaving her in a coma and partially paralyzed, will have to serve the remainder of a nearly 22-year sentence.

Smith failed to convince a Forsyth County, N.C., Superior Court judge Thursday that he did not receive a fair trial in the Dec. 9, 1995, attack.

Smith contended that his original lawyer failed to properly defend him at trial. He also claimed he wasn't even in the shop, had never seen Marker before the trial and that a police officer coerced his statement.

The ruling by Judge Richard Doughton was the right one, said Marker's father, Bud Hoisington on Thursday.

''Oh, yes, I'm sure. I was with her when she told the jury. She could see then, '' said Hoisington, 85, who lives in Green.

Forsyth County Assistant District Attorney Dave Hall called the family with the news following the judge's decision Thursday, Hoisington said.

Hall and a psychiatrist visited Marker a few months ago in preparation for the trial, according to the family.

''They wanted to find out how Jill was and if she was able to remember any more [about the attack],'' Hoisington said.

''They were amazed at her memory,'' added Edna Hoisington, 84, Jill's mother.

Marker, who lives with her parents in Summit County, now requires
24-hour nursing care. The former elementary school teacher sleeps with a ventilator, is partially paralyzed and lost her vision five years ago because of injuries in the attack.

But Marker, 46, said Thursday she remembers every detail of the attack.

''I know it was him. He's guilty,'' Jill whispered as she held up the cap of her ventilation tube.

Authorities said Smith entered the shop and repeatedly hit the 14-week pregnant Marker in the head with a blunt object, possibly a hammer. He fled with $290 from a cash register.

Four months later and while still in a coma, Marker delivered a healthy baby boy named Barron. Her son is now 12 and lives in Canton with his father, Aaron Marker. He visits his mother every weekend, Jill Marker said.

The couple divorced a few years after the incident.

Marker spent the first few years following the attack in hospitals and rehabilitation centers. She won a $9.2 million settlement from the mall, the store where she was working and its partners in 1998. The Hoisingtons built a home in Green complete with facilities for Marker's total care, including a therapy room.

The couple was able to take over guardianship of their daughter and set up a trust fund for her future care with the money from the settlement, Bud Hoisington said.

Financially, it's been rough in the past few months, he said.

''But we're holding in there pretty good,'' he said.

Linda Shankle, a private-duty nurse with Mercy Medical Center in Canton, has been with Marker since 1999. Marker, who undergoes therapy twice a day, has made remarkable improvement through the years.

''She's worked really hard to get where she's at,'' Shankle said.

Today, Marker can walk with the aid of her health-care workers.

''She's a brave one,'' Edna Hoisington added.

He deserves to keep hin behind in prison where he belongs, make him suffer like this poor lady has to do. If I had my choice I would have hit him in the head with a hammer and made him paralyzed and suffer just like the lady did....May you Rott in Prison and never be free again for what you have done, you scum bag.

Mr Kind, no he did not kill her but she is dead in a way....how would you like to have to count on someone to do everything for you all the time? Or maybe you would like to be waited on all the time, anyway the comment you made was inconsiderate and rude.

Too bad he will acutally get out of jail in the story it said he had to serve the REMAINDER OF HIS 22 YEAR setence so he'll be getting out of jail just maybe though he will be too old and frale to beable to hurt anyone ever again
