Driver charged in ninth offense

Man pulled over on day of drunk-driving trial

BARBERTON: It was a familiar routine for a 45-year-old Barberton man pulled over early Wednesday for suspected drunk driving.

Ted E. Cartmel of East Cassell Avenue was stopped by Barberton police just after 1 a.m. — eight hours before he was to face a jury in Summit County Common Pleas Court on his eighth drunk-driving offense.

Cartmel was driving a 1997 Ford pickup, registered to a Marshallville woman, when he was stopped on Wooster Road North.

Police said they found an open 24-ounce can half full of Budweiser beer in the truck. A breath-analysis test registered 0.19 percent blood alcohol — more than twice the legal limit of 0.08.

Cartmel was charged with felony OVI, driving with a suspended license and weaving. He made an initial appearance before Judge Greg Macko.

Macko set Cartmel's bond at $20,000 and appointed Akron attorney Robert Incorvati.

Cartmel is out on bond for his previous drunk-driving arrest in August. That case was scheduled for trial Wednesday before Common Pleas Court Judge Alison McCarty.

Cartmel has been convicted of drunk driving seven times since 1985. He served 89 days in jail in late 2007 and early 2008 following an arrest in 2007, according to court records.

Cartmel was in the Summit County Jail. He is scheduled to return at 1 p.m. today to Barberton Municipal Court.

As a parent of four children please tell me why this Prosecutor Walsh and Judge Mcarty can't keep this man's bond high enough to keep him in jail waiting trial for his 8th offense?

These people should be ashamed.

Bails have to be appropriate/fair/etc. He is not a drug kingpin, serial killer, etc. He is just some alcoholic who doesn't want to get better.

Convicted 7 times with 89 days jail. The eighth offense should then be good for 890 days before release. For the ninth, release would come after 8900 days. Maybe we could get his attention of the difference between right and wrong by then.

you can't convict a person for crimes uou think they may or are going to commit


i wish we had a specific detainment center just for DUIs...he is nothing more than a drunk at the moment, one who cannot stop driving, as Urban renaissance says, and should not be housed with burglars, killers and theives...

judge pike in cuyahoga falls drove home nearly every time from the club he always stopped at, and everyone knew it---this is a serious cultural illness, not a violent crime; judge pike was one of the most fair and likable men to sit on the bench there, but that didn't help contain the problem

My son was diagnosed with Bipolar disorder,of which being an alcoholic is part of that diagnosis. He was charged with felony DUI(5 offenses) & was sentenced to 3 YEARS in prison by a Portage County judge,which I won't name.It cost him everything. He lost his wife,his daughter,his business,his home,his vehicle; as I stated EVERYTHING. This guy got a basically a slap on his wrist,3 MONTHS for felony DUI for his SEVENTH OFFENSE! Is this fair & equal justice?! Also,when will the justice system recognise & accept that alcoholism is a disease,as the medical system does & send these people(patients) to the proper places for treatment & maybe people will be helped! Throwing people in prison really doesn't help,only keeps them away from their addiction,ie.substance abuses,for awhile. I'm sure that everyone knows someone that has an addiction problem,whether it's alcohol,drugs,sex,gambling,shopping,cigarettes,etc.,etc.,etc.!!

What they need to do is go after the real money. Do what they always do: criminalize everybody else. Fine the woman who owned the truck, the gas station that sold him the gas, the parts store that sold him an oil filter. Not to mention going after the beer company, their concomitant advertising firm & distributors, shareholders and scrappers who recycled the aluminum for the can the beer came in.

Obviously this guy could give a fig what the court says about drunk driving. Why not make a little money?

This guy is pathetic. Maybe he's not a serial killer, but if he keeps doing what he's doing, he's going to end up killing someone, which will have just as tragic consequences as if he WERE a serial killer. Any time an innocent person loses their life, whether pre-meditated or not, it's tragic.

the guy is pathetic, he could of killed somebody. Who cares about him, he doesn't care about himself or anybody else. This day & age there is plenty of help out there, no excuse. he is a self centered pig & doesn't deserve one more day of freedom on this earth. He & others like him in society. I am so sick of hearing, "oh they have a disease" Then get help! Don't want to get help? Then get out of our society. I do not have one ounce of respect for him or anyone else in a situation like him. Too many people have lost their loved one due to pigs like him. Our policeman bust them, the lawyers & judges let them out because THEY HAVE THEIR RIGHTS!!!! What if your loved one were killed by a drunk ...judges & lawyers. Then who would you be crying to? What about the rights of the innocent!

How come the teacher in Norton (?) that was DUI for the 4th time gets a felony and this guy gets to wait until 7 or 8? If this guy had been treated the same, he would be locked up for years after TWICE violating felony parole (do the math)!

At least our court system is fair and impartial! NOT!

Where are all the "whiners" regarding OVI check points & saturation patrols today?
Bond must not be unreasonable- whether we like it or not, but no doubt this man will kill someone if he continues.
McCarty was tough in Akron Muni's OVI Court & will likely continue in Common Pleas Court.
Enforcement of the criminal penalties & additional severe penalties for unlawful entrustment & vehicle seizures for those assisting these drunkards needs to follow.
These people need treatment & should receive it, but in a secure jail facility where they should remain for the entire balance of their sentence.

bubbalouie,You're right. The justice system is not fair and equal.This guy should have been jailed along time ago,along with the Norton teacher.
I have a family member in the summit county jail right now on an ovi charge.Sentenced on a third in six years.He recieved 11 months and a 10 year license suppension.This just goes to show that the laws are only for certain people.It's a proven fact especially in summit county.

ITS ALL ABOUT MONEY,people has been drinking and driving for years what bout the drivings that's on the highway driving 30mph thats causes wrecks. this drivers that just want to act out movie and run from the cops.DUIS OR OVI IS ALL BOUT MONEY FOR THE COURT SYSTEM,THEY DON'T GIVE A RATS ASS ABOUT WHO DRINKS. IF the system would put more time finding the homeless a place to live,and leave the drunks alone. or take the money they make off the drunks and help the homeless

ifthe justice system would use the money that they take from the drinkers.And use it to home the homeless. Were does all that ovi money go?.... hmmm laywers, judges ect.. they get the money from the working give it back to the people that lost there homes. the old folks that drive 30or40 mph on the highway now that should be a crime.

He stays out becasue Ted Strickland, Terry Collins and Linda Janes don't want him in prison, they want to save a buck.
Gov. Strickland is a Union Buster and wants to make your neighborhoods unsafe just to save a buck.


Email Linda Janes Deputy Director of Ohio Adult Parole Authority @Linda.janes@odrc.state.oh.us and Ohio Department of Rehabilitation and Corrections Director Terry Collins @ Terry.collins@odrc.state.oh.us and ask why they are going to lay off Parole Officers. All the while letting more inmates out of prison and letting them out quicker. Our streets are not safe enough as it is, it will only get more dangerous out there with less Parole Officers to supervise the criminals.
Ohio DRC/APA have already reduced Parole Officer by almost 70 officers in the last 4 years and now want to lay off as many as 50 more by July of this year.
