Shots fired through wall as woman answers knock at door in middle of night
By Phil Trexler
Beacon Journal staff writer
Published on Tuesday, Apr 28, 2009
The line of bullet holes next to the boarded front door is a dispassionate sign of the street violence that claimed an Akron grandmother.
Diane Mitchell-McMillan, 55, raised her four children in the modest two-story home along Jesse Avenue, a compact, brick-paved neighborhood street in North Akron.
She was home baby-sitting her 7-year-old grandson when a knock came at her front door about 2:30 a.m. Sunday.
A person dressed in a dark jacket with a pointed hooded hat approached the front porch, ignoring a sign to please use the back door.
Neighbors say Mitchell-McMillan may have peeked outside, recognized the trouble and shooed her grandson to the attic. Regardless, in a flash, the intruder fired several shots through the wall next to the front door.
Calls to 911 rang out as neighbors heard the gunshots. Police arrived, broke inside and found Mitchell-McMillan dead near the front door. Her grandson was frightened, but unharmed.
An autopsy was performed by the Summit County Medical Examiner's Office. The results were not released Monday.
Police are seeking the public's help in identifying the shooter. Lt. Rick Edwards said detectives are unsure of the shooter's sex or race.
Neighbors who watched the shooting unfold described a heartless attack.
''I saw a dark-like, large SUV-type, no plates, round headlights pull up,'' said one woman, who did not want to be identified. ''I saw the person get out of the passenger seat. Kind of a small build, couldn't really tell because it was dark and I'm several feet away.
''I watched him walk across the street, go up on the steps . . . I saw him walk across the porch . . . I didn't see the door open, but I thought I heard knocking.
''This person seemed to be on the porch for a couple seconds and then he started to leave the porch and when they did, I heard the gunfire, like four to five shots.
''It was bam, bam, bam, bam and I'm running into my house, not believing what I just saw. I never imagined a person walking across the street and doing this. It's such a shame and her grandbaby was in the house with her. I feel so bad for her family.''
Mitchell-McMillan lived on Jesse Avenue for more than 20 years, raising two sons and two daughters as a single mother. Neighbors said she was friendly, peaceful and hardworking.
Family members could not be reached for comment Monday.
Neighbor Rhiannon Eaton, 24, said she had known Mitchell-McMillan and her children all of her life.
''She was a great lady with such a big heart,'' she said. ''She deserved more than being mauled down in her own home.''
Neighbors say their quiet street by day has a dark side on occasion, with burglaries, nearby drug dealing and domestic quarrels.
Sunday's event was different.
''You have your fights and stuff like that, but never someone shooting into someone's house,'' neighbor Matt Steese said. ''That's inexcusable.''

Wow no comments yet. i find that remarkable
This is errible. I knew that lady and she was really sweet. She lead a quiet peaceful life and did not bother anyone. It sucks that she would be treated this way. I hope they catch the pig that took this fine lady. RIP. my prayers go out to the family and the neighborhood.
First the young kid mowed down in front of his house for his car,and now this. What a terrible thing.Life on the hill just ain't safe anymore.
Cynicism soon follows.
I would not be afraid if I lived in that neighborhood. That attack was obviously a vendetta shooting, if I ever read one. I dont know the family, but someone ticked off the boys with the guns.
While not justified by any means, it is an attack of thinning out the herd, by the herd itself.
Sorry folks, it will always be like that, AND NOT UNIQUE TO AKRON.
My thoughts are for the lady's family as well.
There seems to be quite a bit of these sort of things goin' on in our city. Mebbe once the city hall hero ungrounds himself, he'll take some time to address the growin' crime problem this city has.
hey betamax the city hall hero is too busy scheduling interviews and running his mouth to run a city.
"Burglaries, drug dealings"?
Welcome to Akron!
Too bad Mayor Don Plusquellic is more interested in travelling the world, "putting Akron on the map".
Mr. Mayor, put your buttocks on your chair at 161 S. High St. and do your job of tending to the troubles that lerk in the city you wanted to be elected to govern.
Oh, wait. Too late. He hasn't cared for decades, as well as the economy and crime are reflected in Akron. Do you know what that means? RECALL MAYOR PLUSQUELLIC!
The Lord knows who you "cowards" are and he will ensure justice will be done. Anyone that would shoot a lady because you are not man enough to deal with the real issue is a punk.....
Until all communities condem this type of behavior it will happen over and over again.
Did you read that Marco that comment was for you.
Everyone must support good behavior and achievmente. Throw out the rap music and the punk life styles that have developed. Look at people with this type of behavior with negative attitudes.
The communities must support good behavior in schools and above all support the police.
Did you hear that Don the last comment was for you
I do agree that it was possibly a vendetta shooting/or perhaps the shooter chose the wrong house?
What a horrible thing to happen in front of a child.
My prayers are with the family.
Sounds like a drug deal revenge case that got the wrong house. If I were the neighbors, I'd be watching all the house in the area for late night activity. Chances are good there is a drug house close by.
@ Wathin' in Summit County - Oh, I don't know about that.
It took him weeks to put together that interview. Must of been a good scramble by him and his cadre to cover those expenses.
And hasn't he been runnin' his mouth for years now??
What was more interestin' was him quotin' 15 years of alleged progress to cover two years worth of questionable expenses. Instead of him quotin' what those two years worth of travel and expendatures brought Akron.
Most folks missed that part.
Softball Sponge Don.
Soft on crime.
Akron's indeed on the map.
Home invasions, carjacking/stabbing, senseless shootings. All within a week.
Degenerates Gone Wild.
And summer's two months away.

''You have your fights and stuff like that, but never someone shooting into someone's house,'' neighbor Matt Steese said. ''That's inexcusable.''
Wake UP. Crime is EVERYWHERE. I am sure someone in that neighborhood saw what happen, My prayers are with this woman's family.
Possible a gang initiation, regardless very sad story. My prayers go out to this family and especially the grandson.
A murderer on the loose, and City Council would rather spend $50,000 on cameras to monitor the APD. Yes, crime is everywhere. Thanks to politicians who'd rather bully the cops than hire more of them for our protection.
Why does everyone speculate on this thing. I have never posted a comment, but everyone is getting away from what this story is about. Why are you fighting over which town is better? I feel very sorry for what happened to this lady. We have no idea why this happened. Leave the case breaking to the police! Everyone needs to stop speculating. You don't know these people. Everyone seems to think they know exactly what happened and you don't. My thoughts and prayers go out to the family!
2:30am and the grandkid is still up?? Doesn't anyone ever sleep in Akron?
Stop speculating! You do not know these people!!
Well I'm her family. Please keep us your prayers! Crystal
usecommensense.
mind your own business.
Someone knows who did this heartless act please turn this chump in.
North Hill is part of two Akron wards: Ward 1 is where the shooting took place, Tallmadge Ave, Main St, Cuyahoga Falls Ave, etc. Ward 2 is Tallmadge Ave starting near Dan St and runs up to Brittain Road. The council men are Jim Hurley and Bruce Kilby, respectively. I encourage everyone in these wards to contact their rep and see what's being done about our quality of life. I have never spoke with Mr. Hurley, but when I asked Mr. Kilby, his response was "Crime, huh...I don't know what to say." This type of quitter attitude is not acceptable, in my opinion. If we want to take back our city, we must start with our reps, and mayor. This is election year for city council, I encourage you to do your research and vote this year, its more important now than it ever has been.
Truly horrible for the family.
But does anyone else wonder what the heck the neighbors were doing up and out at 2:30 in the morning to witness this? Their accounts sound as if they were standing right there on the street. ...AT 2:30 IN THE MORNING... very odd, very suspicious.
For UseCommonSense: Nobody said she and her grandson were up at 2:30 am. It said someone knocked on her door and she peeked out to see who was there. She could have gotten out of bed to do it.
Thank you Machinery Man. I don't know these people, however they may have just heard the door, and the chil was awakened as well. I do wonder if she had adult children that may have had enemies or drug debts. These are heartless punks, we need to have something to keep these punks busy, and it doesnt look as though the economy will provide work. Secondly mothers and fathers need to be held accountable, and I do mean accountable for their children. peace and love.
Sad story. And the usual stupid comments about it being the Mayor's fault. Plus the other people speculating on the crime, who did it, why, questioning why this lady (her neighbors and the grandon) were awake at 2:30AM.
Typical ABJ story and comments.
betamax - "...must of..."? Next time, try MUST HAVE.
Oh my..My thoughts & sympathy to Mitchell's family
It Don't Matter What Time Anyone Was Up,Hell I'm Up Half The Night But I Stay Armed,To Bad Yoy Have To Carry A Gun In Your House.
You
To Bad You Have To Carry A Gun In Your House.
I Fixed It
I sincerely feel sorry for anyone clueless enough to believe the mayor of ANY city is responsible for the actions of it's deranged citizens.
For those of you that blame the don for this one, do you realize how utterly ridiculous that is? I humbly suggest you either stop abusing alcohol, stop abusing drugs or seek SERIOUS mental health assistance. Something is very wrong with you...
This was horrible, not just that I know the entire Micthell family all of my life. This can happen to any of us! Stop and think if your human we all are each others keepers, even though we don't want to be. I pray for the family being concerned about why were they up at that time shouldn't be an issue. People usually answer their door whenever someone's there. You all should be gratful that it wasn't your mother, sister, auntie, son, daughter and grandchild. That child has to be tramitized by this.
So what! her son has a crimminal past so what! Everyone has one. We need to be concernred for the fact that this mom was killed and the baby was there. What kind of world are we in to judge anyone for his, or her past or their children so what.
I babysit my grandchildren at times and we often fall asleep in the living room watching t.v. As far as her children are concerned, stop speculating, Diane was a good mother and did the best she knew how to raise her children in the awful crimed infested society. Pray for peace
May god bless this family and comfort them at this time. They have lost an important member of their family. Let's keep the ignorant comments inside of the ignorant minds they come from.
Wow! That is all I can say to the heartless & thoughtlessness of some of these blogs. Another victim, two...hopefully the grandbaby didn't witness any of this.
To the family, my prayers....nobody deserves to have their life taken away.
We answer the knock at the door only if we see a cop car, utility or delivery vehicle outside. A knock at 2:30 AM warrants staying clear from the door and taking the safety off.
God bless the people who have a soul for Diane, and her grandbaby. My great granddaughter and I watch tv into the early mornings in the den. Though we fall asleeep on the couch I wake up and carry her to bed. But if someone knocked at my door that early ( it would usually be someone I know) I certainly would answer it, most normal folks would. She wasn't aware that the knock was going to end her life.
Hey blessthem; not everyone has a criminal past. Check the people you're running with.
SO SO SAD...I HOPE HE IS CAUGHT SOON..OR SHE
Just wanted to let everyone in Akron know that Tampa is full....
its about time for charles bronson to come out of retirement, [oh he died] ah he was way too brutal for this day and time anyway.we got criminal rights you know, its a shame victims dont have many rights, i ll probably hear about this on the evening news right after ten minutes of sports coverage, talk about misplaced priorities,CAN ANYBODY HEAR US OUT THERE WE NEED JUSTICE OLD FASHIONED JUSTICE.
full of what?
This is toooo close to home i live in the area, my heart goes out to the family.
word has it the son ripped off a drug dealer and i guess his mother paid the price, i hope this isnt true but ya never know.
i know i couldnt live with myself if thats the truth.......and i were him.
Norf Hill just ain't what it used to be, Ya'll.
@blessthem "So what! her son has a crimminal past so what! Everyone has one."
Not everyone has a criminal past. In fact, no one in my immediate family has committed any crimes (besides speeding, etc).
Her son having a criminal past is relevent. I am sure it is relevent to the police in looking for her killer. And it is relevent to her neighbors who would be relieved it this wasn't a random act.
That being said, this woman did not deserve to die no matter what the reason. It is tragic and I will pray for the family.
I'AM VERY SORRY ABOUT THE GRANDMOTHER THAT GOT KILL WHILE GRANDSON WAS IN THE HOUSE. I THINK ARE KIDS FORGET WHEN THEY DO SOMETHING IN THE STREET, IT JUST DON'T HURT THEM IT HURTS THERE FAMILY. THAT WOMAN GOT KILL BECAUSE SOMETHING HAPPEN WITH ONE OF HER KIDS IN THE STREET. I HOPE AKRON COPS CLEAN UP NORTH HILL AND LET THE SUMMER BE NICE AND WARM AND SAFTY.
baby's daddy is in richland correctional institution. been there since 08. not due to be released till 10. and baby's mommy was on the news saying this could happen to anyone's grandmother. maybe if her kids and their grandbaby's daddys are criminals.
real tough guy!!!
real gangsta!!!!
sneeks up and kills a grandma.
go brag to your punkass friends, piece of trash!!!
you want to be tough and kill people...join the marines!
oh thats right, they don't take sissies...
Get busy and find this outlaw and bring him to justice.
Tampa is full Of The Same Nuts We Have Here
Be blessed Sheila that you don't. And if you did it really doesn't matter at all. Crimminals come in many forms we aren't always aware of what are family members have, or are doing. Whatever age you are whatever you have done in the past is exactly that.(Past) Having sincere saddness for murder; is the point, all it takes is Having a heart, kindness, and knowing God. I don't have to explain myself or my behavior. I'm mother, grandmother, and greatgrandmother who loves God and my family without judgement. All we need is to learn to treat each other the same as we want for ourselves.
before all you people freak out and lock yourselves in your houses or bother your concilmen, or the mayor or whatever wierdos do. just know that this was no random act.. this was done for a reason. she was a good lady who raised some bad kids.. this was the result of her sons repeated robbing, stealing etc... lets just say theres probably more people hes screwed over in akron than there are on this comment board.
This innocent woman was the victim of yet another bout of senseless violence in the streets today. It really doesn't matter what happened or why. What matters is that it keeps happening to innocent people minding their own business. She got murdered for nothing. Period. That is totally wrong. She was a very nice lady and did not deserve this.
Please allow the police to be cops and start supporting them because no one else is available to attack these thugs. This is not the Tex-Mex border or the murder capital of Ohio. Some summer we are going to have here.......God Bless you and I'm glad you don't have to deal with this town anymore.
what is akron truning into i think we need more officers and we also need to clam back our streets my prayers are with the faimly of this woman
So Sad. I heard the shots. Prayed the moment i heard them. Seen that woman a thousand times. Know her son and counted hers as being one of those good houses on that block that adds stability to the neighborhood.
This hurts on many levels. God Bless the family and the community.
We do watch out for each other in this area regardless of what the haters say. Loosing Diane is hard. Bless the child.
a person was shot and killed. No big deal, rights? Now lets add a couple of words: grandma, 55 years old. So now there is more sympathy?
Now lets add a couple more words: Son in prison, revenge. Now there seem to be not so much sympathy!
Word play. interesting!
So this 55 year old woman babysitting her grandson is up at 2:30am and looks out the door window to see who's knocking. Why would anyone do that? Also how could there be so many witnesses to this violent act? If people would work for a living there wouldn't be so much going on at 2:30am everyone would be asleep in order to rest up for work the next day. Sounds like a nice neighborhood
jwalk: WE must start taking back our city. First by electing people that want to do the job and second because of how bad our country has got to carry a gun. No police could have stopped this shooting as they cant be everywhere. It is up to you to be the first line of defence. Lets have complete families raising children, families with a father present and both mother and father doing their job. Now that would be a good start and in a few years crime and bad acting would go away.
BTW I am married to a grandma it is time to get her another pistol!
The slain lady has a son who does nothing but rob drug dealers and home invasions.I bet he has an idea of who did this.
I feel for this family. How sad. I hope this young one will be okay. He may need lots of therapy. My prayers go out to the family. I hope the person or persons responsibile for this are found. There is no reason for this brutal attack on anyone. No matter what our children have done, parents should not have to be punished, or brought to death.
Thank you poorqpine..you said it!
@Unused Common Sense:
How long have you lived in this area? Never hear of "shift work".
Who do you think keeps 24-hour places open - elves?
This is Birmingham, AL signing in: Diane was a part of our family and what has happened to her was senseless, pointless, unbelievable. We are all heart broken about this tragedy. We are praying for strength for our family members in Akron and we hope that whomever did this is caught. Please continue to pray for the family and uplifting of this young boy who had to come downstairs and find his grandmother slain. Regardless of what the story is and what her children did, SHE did not deserve what happened to her. Everybody, please just stay prayed up.
akron is a cesspool.
I know what you mean, MD23. She paid the ultimate price for her son's constant criminal acts. I pray for the 7 year old.
You did say it right!
Thanks poorqpine!
You people are so mean. Maybe the shooter had a tough life because capitalist republicans expected him to work for something. Don't judge him, he will be on the next Obama bailout of shooters in the hood or "The SITH" bailout. Have some sympathy. You can't expect to sit around in your own house and be safe.
Some of you people are so shallow and ignorant. Just fyi-her grandson is her daughter's child and SHE is not in jail...SMARTONE!!!! AND WHO SAID SHE OPENED THE DOOR AND THEY WERE UP AT 2:30? You know what they say when you assume! The only reason I look at this pathetic blog is because this is my aunt and I live out of state. Other than that some of you people are part of the problem in this world and we are each other's keeper. No one deserves to die the way my aunt did. I hope and pray that none of you have to experience this no matter how ignorant you are. I always to my kids knowledge is power...think about it. For a change!
P.S. I live in an upscale neighborhood but it's crime here. It's the morality and values of one's belief system which sperates good from evil...think about it. Knowledge is power so don't always assume!
MD23--Who murdered her then? You seem to know sooo much. Tell us and the police! My male cousins were no boyscouts sooo....because of that it's okay that my aunt was murdered? No! You need a reality check. Oh by the way since we're being REAL. Where did you aquire your MD?????
Somebody made someone mad, that's obvious!
Whether it was a family member and they thought that person was the one in the house, or whether the shooter just got the wrong house, that was a hit job gone bad!
I feel bad for this poor woman who got caught in the middle. I hope they catch this guy soon!
hey chris........u ever had your mother killed because of your senceless acts.....idiot
I AM ONE OF AUNTY'S DI'S NEICES, AND I FIND IT SUCH A DISGRACE TO OUR FAMILY THAT PEOPLE CAN BE SO CRUEL AND HEARTLESS!! IT AMAZES ME TO KNOW THAT PEOPLE CAN PASS JUDGEMENT SO QUICKLY AND IT BE JUSTIFIED AS SUCH. HERE IT IS, MY AUNT HAS LOST HER LIFE AND ALL YOU PEOPLE CAN THINK ABOUT IS SOMEONE BEING UP IN A SPECIFIC NEIGHBORHOOD AT A CERTAIN HOUR!!! REGARDLESS AS TO WHAT THE CIRCUMSTANCES WERE OR COULD BE, NO HUMAN BEING DESRVES TO BE "ASSASSINATED"!! FOR THOSE OF YOU THAT HAVE NEVER EVER HAD A TRAGEDY SUCH AS THIS HAPPEN TO ANY OF YOUR LOVED ONES, SHOULDN'T HAVE AN OPINION OR A COMMENT, JUST COULDN'T SHOW JUST A SMALL BIT OF COMPASSION HUH? BUT I GUESS WHO WOULD EVEN CARE? THAT WOULD BE TOO MUCH LIKE BEING A CARING HUMAN BEING, JUST AS OUR HEAVENLY FATHER WOULD LIKE FOR US TO BE!! HE IS OUR JUDGE AND ONLY JUDGE!
Hey C,
Ask your cousin who did it. I'll bet he knows. I'm sorry for your loss and I hope that the child can cope with this somehow.
C - don't let the idiots upset you. I'll say a prayer for your aunt & the rest of your family.
sad thing terrible thing-this is what akron has become under the current administration
i and my people will be praying for this family and continue to pray for a new administration that cares about the people who do not have a ceo in the family
