Adult entertainment owners, trade group fail to get state's 'no-touch' rule declared unconstitutional

A federal judge has upheld Ohio's ''no-touch'' law for strip clubs in Akron and around the state.

A group of adult entertainment owners and the Buckeye Association of Club Executives, a not-for-profit trade group that represents cabarets and adult bookstores, had sued in U.S. District Court seeking to have the state's no-touch law declared unconstitutional.

Akron was among several cities and counties named as defendants in the lawsuit filed in October 2007. The suit came in reaction to new state laws covering exotic dance clubs and adult bookstores.

Judge Solomon Oliver Jr., in a 45-page decision released Monday, granted motions by local government attorneys to have the suit dismissed.

A message left with Berkman, Gordon, Murray & DeVan, a Cleveland law firm representing the adult entertainment groups, was not returned.

Oliver found that the state law that bans exotic dancers and customers from touching each other does not violate First Amendment or other constitutional rights of the business owners.

The judge also upheld the state law that limits the hours of operation for adult clubs that serve liquor.

Oliver disagreed with claims from club owners that the ''no touch'' law violated freedom of speech guarantees.

He also disagreed with arguments that the ban is overly broad and could be applied to ballet dancers or other mainstream theatrical performers.

''Indeed, there is no evidence before the court that musicals such as Hair are characterized by an emphasis on specified sexual activities or anatomical areas,'' the judge wrote in his decision.

Thank Phil Burress and Citizens for Community Values for this. Next on their real hit list: ban on adoption by un-married couples, outlaw the sale of sex toys, shut down erotic stores, adult book stores. They're also known for hanging around Proctor & Gamble's offices protesting and harassing people after that company started offering benefits to domestic partners of their employers.

wow, I didn't know that was the law now back in Ohio. Wasn't like that when I was 17 sneaking into XTC back in the good ol days haha..and it certaintly isn't like that out hear in Vegas haha I would never move back to the dump of Ohio!

Most of these women are single mothers without support, job skills, or have lost their better job in this economy, trying to support their kids without resorting to 100% real prostitution. Is the idea of this to make sure that they do that instead?

I think any individual can determine for themselves if they want to be touched or not. I don't need laws making my mind up for me. We allow abortions because a woman has the right because its her body. Well, its my body and I don't have a problem with a hot dancer rubbing her rump on my leg...... So it's illegal to allow a dancer to touch my body but it is legal for a woman to allow a doctor to perform an abortion. Makes no sense!

I think it is time for a background check on Phil Burress and all the members of the Citizens for Community Values . . . execute a search that is as thorough as a nearsighted proctologist on a polyp safari!

I bet you'll find someone that was touched inappropriately . . . probably by Phil.

This is just an awful application of state legislature. Why must our state mire itself in nanny tactics, trying to save us from ourselves with strip club and gambling laws, instead of making this area economically viable again? Local and state leaders, if it's not about JOBS then we don't want to hear it.
