As Mayor Don Plusquellic stood in the middle of a large brawl outside a downtown Akron nightclub early Sunday morning, he figured he may be at a homicide scene.
A 22-year-old Parma man lay unconscious on the street, beaten by an unknown attacker.
One thought entered the mayor's mind: The city couldn't ''botch'' the investigation like it had with an alleged racial attack in June at Firestone Park.
That incident — where a mob of black youths beat white people after a fireworks show — exploded into national news when the media uncovered witnesses who were never interviewed by police. Authorities failed to identify and follow up on multiple 911 calls.
''The only thing I have in my mind is that this can't be botched like the Firestone incident,'' Plusquellic said.
Right or wrong, the mayor took charge.
He, along with others, called 911 to report the incident. He also ordered the police sergeant at the 911 dispatch center to begin compiling the calls.
And he started helping with the investigation at the scene, identifying potential witnesses and advising police whom they should interview.
But now the mayor, who acknowledges he had been drinking that night, faces questions about his behavior.
Was he a good Samaritan helping police catch the attacker? Or was he a politician meddling with a police investigation?
The night
Earlier in the day, Plusquellic had welcomed audiences at the Ballet Summer Festival at Glendale Cemetery and at a concert at Lock 3 downtown.
At 10:50 p.m., he met friends at Bricco, a favorite hangout for Democrats at the intersection of South Main and Exchange streets.
He left the bar around 2:30 a.m. with Summit County Democratic Party Chairman Wayne Jones and Barberton Clerk of Courts Andrew Padrutt. They saw a rush of people come from around the corner toward them.
They went toward the mass to see what had happened and witnessed a brawl that had started outside the Lux Nightclub, 1 W. Exchange St.
The mayor called 911 twice but was put on hold. When police arrived, Plusquellic said, he tried to steer them to witnesses but encountered an arrogant attitude.
However, police say the mayor had been drinking and was interfering with the investigation, including being verbally abusive to officers. Plusquellic was lucky he wasn't charged with disorderly conduct, said Paul Hlynsky, head of the police union.
The officers involved declined to comment through the union, fearing retaliation from the mayor, Hlynsky said.
A police report noted that the mayor's speech was slurred.
The city released three 911 calls with the mayor that reveal a forceful and coherent Plusquellic talking with dispatchers and a police sergeant. He does not slur on the 911 tapes.
Also, for a man who regularly uses strong language, he is restrained on the tapes, uttering just two swear words.
The mayor, who left today for a weeklong trip to Japan, said the union's claims are untrue and meant to smear him. Plusquellic and the union have sparred over numerous issues.
As the safety director, Plusquellic said he had the authority to assist the police and wanted to ''make sure the cops don't look like blundering idiots and this is the thanks I get.''
Hlynsky, who was not at the scene of the fight, said the union is still gathering information.
''People are focusing on the 911 calls but that is a small part of the issue,'' he said. ''What happened on the scene is the bigger issue. . . . His actions were inappropriate. Cussing at police in front of citizens is atrocious behavior.''
Padrutt and Jones backed the mayor's version, saying he wasn't drunk and they didn't see Plusquellic abuse the officers.
Jones said Plusquellic stopped three or four witnesses from leaving the scene.
''He was trying to help the situation,'' Jones said. ''He could have kept walking to his car and said, 'The hell with it,' but he didn't.''
Padrutt added: ''I think he did what you want and expect a mayor to do.''
The 22-year-old victim remained at Akron General Medical Center today. His family asked that the hospital not release information on his condition.
Police arrested Anoulak Phengpraseuth, 23, of Akron and charged him with felonious assault.
Investigation ongoing
Additional arrests are possible, police Capt. Dan Zampelli said.
Police are talking to witnesses, including Plusquellic, and examining surveillance videos.
One city surveillance camera shows people fighting in the middle of Main Street and people running. A second city camera was pointed away from the fight.
A camera from Lux was focused on the entrance to the club, so the beginning of the fight can be seen outside and moving away.
Zampelli said the department's focus is on the ''young man who was brutally beaten and knocked unconscious'' and not on Plusquellic.
''We as a police administration are not going to get in the middle of that,'' he said.
An 18-year-old North Olmsted woman, who is friends with the man who was assaulted, was among the 911 callers.
The woman, who asked that her name not be used for fear of retaliation, said the brawl started as people were leaving Lux. She said her friend and Phengpraseuth started arguing and then fighting and others joined in.
She said her friend walked away but another man ran up to him and hit him in the face. She heard his head hit the sidewalk. He was unresponsive and bleeding as she called 911.
''I want him to get back where he was,'' she said, sobbing, of her friend's recovery. ''There's no guarantee of that.''
Kelly Williams-Bolar, 39, of Copley Township, was trying to turn onto Exchange from Main Street — driving home — when the fight literally stopped her. She said she blared her horn but the group of at least 12 to 15 people showed no reaction.
Williams-Bolar said she saw a man on the ground and someone said he might be dead.
''I didn't want to put my car in reverse but I wanted to get out of there,'' she said.
Williams-Bolar ended up with a dent on her bumper that she thinks might have been caused by someone's head hitting it.

Officers at scene?
Plusquellic questioned why there weren't police stationed downtown when the bars closed.
Zampelli said many of the Akron bars have hired off-duty police to provide security but the Lux no longer does. He said the department tries to have officers downtown ''as resources are available. That evening, none were down there.''
Ray Dean, a manager at Lux, said the fight didn't start in the club. He said he didn't recognize the people involved in the fight and they could have ''come from any bar. Most were probably in every bar that night.''
George Romanoski, who heads the city's dispatch center, said the first 911 call on the fight came in at 2:31 a.m. and a dispatcher immediately called for police and paramedics. He said they were on the scene within three minutes, which he said is under the average response time.
Romanoski said 911 callers are put on hold only when the dispatchers are tied up with other 911 calls. He said they are asked to remain on the line.
Romanoski declined to comment on the Firestone Park incident, except to say it remains under investigation.
Despite the two recent incidents, Romanoski said there are few complaints about delays with 911 calls. He is studying how often there are delays.
Romanoski said the dispatch center is down 15 employees, from its full strength of 65, but the extra hours are being made up by employees working overtime. He can't hire right now because of the budget crunch.
Romanoski said he will make suggestions in the next few weeks on possible steps to curtail people being put on hold.
''I don't think you will ever eliminate getting a busy [signal],'' he said. ''We can't afford to staff with the number needed to prevent that from happening.''

Crazy no cops down there at closing time...
The mayor was out of line. It isn't his job to be part of a police action or investigation.
After 5 years living in Akron, I am astonished how negative many people are towards the mayor. Sure, he was definitely out of line by verbally abusing police officers. The police have a difficult high-stress job and deserve respect. That being said, people should also give the mayor respect. Compared to it's neighbors, Cleveland, Youngstown, and Canton; Akron is not listed in national publications as the 'fasted declining', or 'worst cities to live in'. On the contrary it is considered an "All American City" - because of effective leadership. Careful what you wish for...
Consider the mayor's intentions before you pass judgment. Was he trying to hurt or HELP?

He was drunk, clearly slurring his words in one of the recorded calls, and heading for his car when this all happened. What an a55!

It is an issue as he is not any average citizen but the Mayor of Akron. Was he home sleeping at 2:30am? Was he in his office working late? No, he was getting drunk and heading for his car. That is an issue. Imagine Otis, the town drunk, serving as Mayor of Mayberry. Andy wouldn't put up with it and neither should the APD or the citizens of Akron.

What would the mayor do to an officer who was trying to perform his/her duty if they admitted they had been drinking. They Mayor himself that he had been drinking, therefore he had no business doing anything in the position of Safety Director. City Council you need to act, if one of these officer had been on duty drunk they would have been fired. Don was on dity as Safety Directer under the influence of alcohol, and he admits it.
I say start another Recall now. Unless the City Council has the Balls to start imoeachment proceedings for abuse of power and the mayor performing his duties under the influence of alcohol.

Akron is doing markedly better than the average for Ohio as well as the nation.

He directed the police to a witness - what a scoundrel!
He insisted, in strong terms, accountability - what an a%^hole!

You want more cops downtown at that time? Hire more. They are understaffed as it is. they cant be everywhere. If they were downtown waiting for something to happen and nothing did, the story would be, "why were there 10 cops downtown and nothing was going on. They should be patrolling the streets."

No Clue, remember the cops at the bar in east Akron? They were drinking in a place that served alcohol, with a weapon, the bar got robbed and they shot and missed the robbers? If cops can drink, carry a gun in a bar and shoot at robbers why cant the Mayor drink and do his job? At least the mayor didnt break Ohio law.

He could have walked away and pretended like nothing was wrong, or he could have done what he did, which was try to help.

Imagine THAT headline!
Being put on hold or the phone being picked up by a recorded message is nothing new. The very same thing happened to me this past week. I was attempting to reach 911 while witnessing a fight on 18th Street in Kenmore. If the Mayor wants better response time he should be thinking about hiring more dispatchers, police, fire and rescue personnel instead of making cuts in their staff!
Slovensko ... The issue here is that the Mayor tries to do everyone else's job. He should concentrate on doing his own job and leave the Police to do what they have been trained to do!
Would be glad to tell him myself ... But he is on his way to Japan spending money that should be spent on recruiting more Police dispatchers!

Going to Japan??? How many of his friends including his girlfriend is he taking at taxpayers expense.
I knew the Beacon wouldn't let their generally negative about the Mayor story stand for long. Now they issue this counter strike direct from the mayor's office. For a minute there I thought we had a newspaper independent of the mayors influence.
I'm done concerning myself about stories like this. Too many polarizing issues....
Just read the mayors written response, you have to admit he makes a reasonable argument two days later. He's leaving out the part about him screaming at the police and getting angry...two side to every story sir.
this is just ridiculous. the mayor is an id&^t. they wouldn't have a staffing problem if he would hire more police. and now he is going lay more off. did I mention he is an id*&t?
I think we should provide the mayor withhis own direct line into 911, kinda like the bat phone. We will call it the Don phone. After calling on his Don phone, he can jump into his Don mobile and fight crime all over the city of Akron
And he brings the Firestone Park incident into this to bash the police? The police were the problem at Firestone Park?
Elements of this story sum up many of the problems we have with this city's administration.

Quit making stuff up. I listened to the tapes (Ohio.com and AkronNewsNow had them available). The mayor did not sound drunk and disorderly. Even the Beacon reported that he was not slurring his words.
Had the Mayor walked away from the situation, as he could of, then people like you would have been screaming for his head.
Instead, he got involved and tried to do the right thing -- and now, someone is sitting in jail charged with the crime, as opposed to the Firestone Park incident, where the thugs are still being protected by the 'don't snitch' mentality.
OMG: None of your business ... you live in Tallmadge and your mayor's only concern is whether or not to allow dancing chickens! If the APD has a grudge against the mayor (because they lost their recall election), let them quit and move to another town. Everyone has options!

Actually, no he didn't. He can command the police dept, but only under certaiun protocols. He can't take command of anythin' once he's had a drink.
I question the city hall hero's comments because he's in charge of the safety forces, his hand picked men are the chief of the police dept and the communications center respectively.
For him to say that the Firestone incident was botched and he now knows why citzens feel like they do about our police, jes' shows how out of touch he is with the system he's in charge of.
He's had ample opportunity to make changes in both areas, should they have needed changes.
Of course, we now have to wait until he returns from the current vacation, so we can hear what sort of changes he intends to impliment. One would think that iff'n the incident is that much of a concern, he'd have stayed to make sure changes were made immediately. Obviously it isn't a problem of importance.
What concerns me is that a drunken Mayor thinks he can perform better than sober cops. There's a BIG problem in the city.
OMG and Betamax: If you both think you can do a better job, why don't you run for Mayor. Easy to sit behind a computer all day and make your nasty comments! So the Mayor is attending a mayor's conference in Japan ... so what? No different than Obama taking a vacation (after only 7 months in office), renting a $20 million vacation home, and all at the taxpayers' expense! I guess it's called "perks of the job." Not defending the Mayor here but it sure seems like our 911 system could use some major protocol changes. The one thing the Mayor is referring to is how some callers tried to report those thugs in Firestone Park but were put on hold and couldn't get through.

Blkswn, it appears that the mayor was concerned about the accusation against the police made in the BJ reference the Firestone Park incident. See the below quote:
"John Alchier, who witnessed the attacks on his brother and friend, remains critical of the police response. He said Wednesday he still believes he was told there were suspects stopped by police and that officers refused to let him see the teens.
Police acknowledge they have not interviewed Alchier since the attack. (The detective) said he intends to meet with Alchier............ Alchier also still says police were slow to respond to the scene and again in publicizing the incident. He has filed a complaint with the department.
'It's their word against ours, and they will be believed. We all know that,' Alchier said."
It sounds like this is his concern on his 911 call where he demands accountability rather than apparent confusion.
The 911 system needs staff. That is part of this story and the Beacon needs to investigate it. It is short on a daily basis. Additionally, the Mayor jammed up the lines with his impatience. By calling and hanging up he caused what staff there was to attempt to call him back each time. I think he admitted to four hangup calls on the tape.
Our debt is affecting our safety.
First, none of you know he was drunk because I do not remember reading about a breathe or blood test. Second, the 911 calls do not demonstrate he was drunk either. I would love to hear how some of you sound in an emergency, especially with a large number of people around and activity still having. There is a reason people are not prosecuted on being drunk by a phone call alone, because there is no way any of you are experts in speech recognition and patterns. We also do not know he was on his way to his car or that he was driving. Finally, mayor or not, a person has the right to being out no matter the time of day. Thanks to the people that came before us and all the veterans we have the freedom to be out at any hour, and we can do anything we want within the limits of the law. As usual, many of you are making judgment calls before all the evidence is even available. It would be different of you were an eye witness, but have not seen that statement made from any of you either.

With all the to-do with the recall and people anti- mayor i think he should have been careful about being out that late having drinks at all - and yes i agree he is an adult and there is nothing wrong with him having a few drinks but he had to know - fight or no fight people would make comments - it was get spun into "he was drunk and slurring word.... " regardless of what happened - and regardless if he had 1 beer or 20.
That being said I think the Police probably didn't use common sense in being rude, etc.

The mayor didn't get put on hold, he got a busy signal, hung up and kept calling back. The dispatch center only has 14 lines. For a city as large as Akron, 14 lines can be tied up in no time at all. If the mayor would let some of his 17 deputy mayors go, maybe the city could pay for more phone lines for the dispatch center and more officers to staff it. The FOP's vote on the recall stance was barely tipped in favor of the recall by less than ten votes. That being said, not all the police on the force are against the mayor's job performance. So it is very likely that the patrolmen on the scene still respected the mayor, but reported the facts as far as his demeanor and his slurred speech.
The mayor is going to jump all over the police department after the recall vote failed and the FOP had voted in favor of it. He needs to do a better job with the city's safety forces yet altough he is in charge, he is complaining about the poor job they have done which is really a reflection on him.
Mendenhall start another recall effort. COuncil look real hard at impeachment proceedings. He overstepped is legal boundaries
The Mayor has ignored the police department for years and shirked his responsibility as Chief Safety Officer for the city. Then at 2:30am Sunday morning, after drinking all night, he wants to assert his authority? He sounds drunk and confused on the 911 calls.
Its amazing how this story has gotten spun to keep Don on that high pedestal he so aptly puts himself. If you were there, as I was, you would have seen a completely different scene then the one portrayed here.
The ABJ published a story just a couple of weeks ago about the great arrest and conviction rate by the Akron Police Department for the city's homicides. Who do you think figures greatly into the solveability of those incidents? Thats right, the first responding patrol officers who identify witnesses and gather evidence! I don't know how they ever did it without Don's direction!!??

We all know the Mayor lied prior to the recall about hiring police and the financial condition of the city and he expects us to beleive him about this incident? The guy is a pathological liar and a heavy duty drunk. He is out everynight boozing, look at the city credit cards and his campaign credit card statements, compliments of Warner.
It is on the record Plusquellic threatened police officers at downtown bars not to support the recall. Plusqellic said the cops would be "driving sleds" if they did. This is just more of the same, vindictive Don! And Akron suffers.

Iff'n he doesn't have it on speed dial, it destroys his credibility, when he was quoted on the parkin' lot attendant incident, about havin' to be able to be in contact with the city in case of an emergency.
The mayor is traveling to Japan? On whose dollar? Who is accompanying him? Why should extra police officers be stationed downtown when we need them in our neighborhoods too. Calling 911 only to be put on hold is frightening. Time seems to stand still. When I was put on hold it was midnight on a Sunday night. I have also called the 375 exchange only to hear it ring and ring and ring. After calling for over 30 minutes one night, I finally hung up. The criminals were long gone after that. The mayor should be concerned with the safety of all the citizens. He needs to address this issue of busy calls to the dispatch center and put more people on the job. The police have their hands tied in this city. There simply are not enough of them to fight all the Akron crime. Wake up mayor. Stay at home for a change and deal with the crime in this city!

Akron Police Officers are trained to OPOTC standards and recieve additional advanced training, as well. They work in an urban atmosphere and are seasoned, experienced professionals. If the mayor knows how to do their job so well, why didn't he put HIS life in jepordy and break up the fight himself? They mayor also wanted to mke sure that the police did not botch another incident like the one in Firestone Park. There is no doubt that the police have botched that one. Summit County Democratic Chairman Wayne Jones and Barberton clerk of courts Andy Padrutt were also with the mayor and both of them have said the mayor was not slurring his owrds or see the mayor abuse the officers. But then we have egocentric Paul Hlynsky once again getting up on his soap box and proclaiming the mayor was verbally abusive and the "mayor was lucky he wasn't charged with disordley conduct". Sorry Hlynsky, but I'm not buying your version. I think the truth is the mayor did try to help but the officers resented his involement due to your hatred for the mayor. You love nothing but stirring up the pot against the mayor every chance you get. Like you stated, you were not there, so quit making assumptions. Firestone park is the product of Marco Sommerville, the failed Police Auditor and Plusquellic. they cut the department and work people overtime in stressful jobs and wonder why things happen, DUH.

Well...everyone is frustrated when that happens...however..I think he was trying to help but also being his normal control freak self. If he had something negative to say to or about a police officer it should not have been done while the officer was trying to manage a crime scene or in the public eye. Yes, he has done good things for Akron. He also is a person I would have no interest in being around socially. He is a boor and full of himself.
WOW... lots of give and take here. Obviously, the mayor should NOT have gotten personally involved in the matter, he is not a trained police officer. Jeff was there and saw how the mayor was acting, from that description I would say, at the very least, the mayor was not acting in a manner befitting his office. Was he "drunk", I can't say, no one officially can, but again his actions do make it appear that he had a couple under his belt at least.
The mayor continuously promises to beef up the APD, now it can happen with the stimulus money, question still be answered is how many APD will be laid off and will the new hires result in a net gain in the end?

@selket I take it then that you are assuming that police officers were busy stuffing their faces during that time... yes? Do you have any proof of this are you just spouting off because you occasionally see an officer in uniform at a restaurant?? Are they not entitled to a meal break? Even when they are on meal breaks, their radios are on and will leave the meal in mid bite when the need arises. The same is true of the AFD at the station houses. Not many other occupations require that level of commitment.

It is not a lie until either the stimulus funds are not approved and/or he does not fund it from another funding source. Nothing he promised about the police is a lie yet because everything is still happening according to the advertised timeline (Stimulus funds awarded during the summer).

The mayor closes a bar down after being there at least three hours, is abusive to the dispatcher, radio room sergeant and many officers on the scene, is given a break by not being locked up for his actions, and the Beacon spins it to make him look like the good guy!
As a lifelong city resident and retired APD and city worker with over thirty years of service, I am apalled by what this once great newspaper has become.

the officers are always on duty including their lunch or dinner hour. therefore, when you see them eating in their uniform, they are still on duty and are entitled to lunch or dinner. and furthermore regarding your comment regarding them being at the bars when they close. It is not their job to babysit drunk people when they leave a bar. that is the job of the bar owner to keep his place safe. if he is overserving his patrons and they act like animals then that is his problem. the officers didn't put 20 bars right next to eachother, that was the plan of your drunk mayor to make the city of akron more attractive. and then he plops a dorm right in the middle. maybe if he would put down his drink he might have actually figured out that wasn't such a smart idea.

It is amazing how the story gets changed to support the mayor. If u had been there on the sidewalk, u would have heard him call an officer an ***hole and point in his face. The officer seemed to be interviewing someone and was merely asking questions. The mayor appeared to not like the manner in which the officer was asking the questions. I dont know if he was drunk but it sure seemed like he was not completely sober. Look, when u get drunk or drink too much and are confronted the next day about something questionable u may have done....What would u say?

There's always a break-point where it's cheaper to pay OT and keep a smaller workforce due to fixed costs (benefits). Every business with non-exempt employees usually factors this into headcount (to varying degrees).
Akron police have definitely appeared to be inept and extremely incompetent recently, but this just seems like the blind leading the blind.

Best friends with one of the cops that was onscene. He was so mad about it that he almost didn't want to talk about it. He said that the Mayor was calling them names, pointing his finger in an officers face. He said if it wasn't for the police sgt. that was there, telling them not to arrest the mayor that it would just make things worse, Don would have been cuffed and stuffed. Also stated that the mayor smelled of booze and his sentences were broken as they also sounded on the tapes. The best was that he got in his car and drove away. He said they all officers wrote on the incident to make sure their T's are crossed. Also, copies of the tapes were made before being sent to the Mayors office. City council needs to step up on this one. You can't function in the capacity of the Safety Director when you have been drinking! You also can't drink and drive a city vehicle. Those 2 things along with interfearing with a police investigation should all be looked at. Hold the guy accountable for once!

This scene was a mess. The Mayor CANNOT serve as the safety director when drinking...whether he was drunk or not, he admitted to having more than two drinks. He ranted and raved at the officers there...and only a cool headed supervisor prevented him from being arrested. The officers there were LIVID at his actions and the way he treated them.
Remember during the recall...I told you he would stay in office and be stronger. He now feels invincible. He has done a lot for the city, but it is time for him to go. He is a bully and NO one likes a bully.
I am calling for the mayor to resign immediately. He brings shame to the City of Akron.

Comp time? You sill can't cover a long-term shortage by issuing comp time (unless you never honor the comp time).
I read the City website and Kelli ( Is she goth?) says she is employed by the Ohio Democratic Party as a Consultant. I will check with the Ohio Ethic's Commission to see if kelli is legal.
She formerly worked for the County and that may have been a conflict but that conflict could extend for 24 months, again i will check.

What was wrong with the APD and AFD response times to this incident? 3 minutes for APD and AFD had the victim to the hospital within 17 minutes? What more can you ask for? The Don has definitely overstepped his boundaries on this one. I wonder if the city charter allows the so-called " Safety Director" to use his powers while under the influence of alcohol, whether it be 1 drink or 10? @McDonald - Comp time and personal time are two different things. As I understand it, compt time is accumilated because the employees worked the time, but by contract, get to get this defered to a later date, like retirement.
Personal time, is free time given to the city executives because they can.
The city hall hero receives 32 hr/week in personal time. The least amount any of them receive is 8 hr/week.

I don't fault him for calling to report the incident, but then calling four times to complain during one of the busiest times of the night, while the call center is understaffed? Then screaming at the cops, causing a scene...interfering with them doing their job...I can't see how anybody but the mayor's lackeys can defend that.

He should have been arrested for disorderly conduct..DUI..the officers were trying to question witnesses and he got verbally abusive with the police and refused to leave. Then he squealed his tires driving drunk in his city vehicle. The mayor has been known to start fights with off duty Akron officers at bars, calling them out to fight outside. What an A-hole.

Reading all these comments, having lived here in Akron for 28 years...all we see is hateful people chiming in on a personal issue. Does the Mayor drink, yes. Is it a crime to do so after work hours, no. Does he stop caring about the city after work hours, no. Has this city flourished for decades under the man's uncanny leadership through very tough time for mid-size industrial towns in the midwest, yes. Big Yes. So personal issues aside, you owe this man your silence at the very least for participating in the cities future far more than you do.
