Woman contends she received an eviction notice after ex-boyfriend tried to break into apartment

A sex discrimination lawsuit has been filed against the Akron Metropolitan Housing Authority for trying to evict a woman who claims she is being thrown out because she is a victim of domestic violence.

The suit, brought by the public housing tenant through Fair Housing Advocates Association, contends the woman was served an eviction notice after a former boyfriend broke into her apartment.

AMHA had banned the boyfriend from the apartment complex before the July 13 incident, the suit says.

Fair Housing said AMHA issued the eviction notice after the woman had called police to report that the former boyfriend had broken into her apartment to take a window air conditioner.

The 30-year-old woman lives in the Honey Locust Gardens on Graham Road in Cuyahoga Falls.

Fair Housing said it discovered AMHA had a security camera in the parking lot that recorded the July break-in.

Fair Housing Executive Director Vince Curry said that because AMHA failed to retrieve the video and allowed the camera to record over the footage, the woman lost evidence that would have proved the break-in.

Curry said Fair Housing also has notarized statements from neighbors who saw the man casing the apartment and removing the air-conditioning unit from a window during the break-in.

But according to police records, Cuyahoga Falls officers, who answered the initial call, rejected a claim of domestic violence.

The report also includes a 911 call to dispatch asking for EMS service for a head wound. The call came from the man accused of attacking the woman. He was taken to Summa Western Reserve Hospital for stitches.

The report said both parties suffered head injuries. The woman was treated at the scene.

The officer wrote on the incident report: ''Due to conflicting stories and lack of an independent witness, both parties were referred to the prosecutor.''

The 25-year-old Akron man was cited at the hospital for trespassing on AMHA property.

He pleaded guilty to the criminal trespass charge on July 17 in Stow Municipal Court, served three days in jail and was fined $100.

Meanwhile, AMHA also rejected the claim that the ex-boyfriend broke into the apartment and has refused to stop the eviction.

Housing discrimination complaints are filed with the U.S. Department of Housing and Urban Development.
