CINCINNATI: A federal appeals court has denied an Ohio inmate’s request to overturn her convictions for aggravated vehicular homicide and drunken driving in her 6-year-old daughter’s death.
Kelly Volpe of suburban Columbus woman was found guilty in 2006 after she crashed her pickup into a tree, causing the death of her daughter the following day from injuries sustained after the girl was thrown from the vehicle.
Volpe, who received the maximum 20 ½-year sentence, argued the convictions violated the constitutional prohibition against multiple punishments for the same offense and said the convictions should have been merged for sentencing purposes.
The 6th U.S. Circuit Court of Appeals in Cincinnati on Thursday said Volpe had been properly sentenced.
Volpe’s attorney did not immediately return a call for comment Thursday.
