A former Akron councilman accused of drinking while driving with a child in his vehicle was arraigned in Stow Municipal Court.

Bruce Kilby, 63, appeared Wednesday before Judge Kim Hoover and pleaded not guilty to one count of misdemeanor consumption in a motor vehicle and one count of endangering children.

Hoover set a Feb. 4 pretrial date and ordered Kilby released on a signature bond.

According to Tallmadge police, a witness flagged down an officer and reported seeing a driver drinking from a beer bottle at 5:30 p.m. Sunday as he pulled into the parking lot of Dollar General, 515 South Ave.

The officer reported that he pulled into the lot and saw the driver, later identified as Kilby, put something on the floor of the vehicle by his feet. That’s where the officer said he found a 12-ounce bottle of Budweiser.

Kilby’s 8-year-old grandson was in the backseat.

Reached by phone, Kilby declined to comment on the charges. He referred questions to his attorney.

Kilby resigned his Ward 2 seat Nov. 30 after serving 16 years during two stints on the Akron City Council.

His resignation came one month before the end of his term, and two months after failing to finish in the top three in the Democratic primary in his bid to win an at-large council seat.
