A Portage County judge has dismissed criminal charges levied against a Mogadore police officer following a New Year’s Eve party at his home.
Judge Laurie Pittman dismissed the charges against Mark Halliwill in mid trial, finding a lack of evidence brought to court by prosecutors and Portage County sheriff’s deputies.
Halliwill contended at his trial, late last month, that he acted in self-defense.
A message seeking comment from Mogadore Police Chief Todd Higgins was not immediately returned Monday.
A family member said Halliwill has resigned from the department.
Halliwill had been on paid leave since being charged Jan. 1. He was accused of pointing a gun at a fellow officer during the New Year’s Eve party. Charges included felonious assault.
No shots were fired.
Pittman found that the other officer had no right to be inside Halliwill’s home and that he was within his right to defend his property.
