A 15-year-old Tallmadge High School football player was accosted by several teammates last year, attorneys for the prosecution and defense agreed today in opening statements in the rape trial of two teammates.
The attorneys said that during the altercation, the victim was forced to the ground, had his pants pulled down and was jabbed in the buttocks with a drinking straw.
What attorneys don't agree upon is whether the attack was premeditated and if the straw penetrated the victim's rectum, which is crucial to establishing a rape charge.
One of the teammates -- a 17-year-old junior -- is charged with delinquency by rape and hazing in connection with the incident, which occurred on school property. The other -- a 17-year-old senior -- is charged with felony delinquency by complicity to commit rape and hazing.
One witness -- a teammate -- described the incident as a simple hazing.
A tape recording, made shortly after the arrests of the two players, was played in court this morning.
One of the defendants can be heard saying, ''Rape? Are they serious?''
The trial is expected to last two days before Judge Linda Teodosio.
In December, a 17-year-old teammate was given 40 hours of community service and other sanctions after pleading guilty to a delinquency charge of disorderly conduct for his role in the incident.
In November, charges against a 16-year-old were dismissed by recommendation of the prosecutors.
Two other players, one 16 and one 17, each pleaded guilty to one delinquency charge of hazing.
Those youths were given 40 hours of community service and ordered to write a five-page essay on bullying.
They also were ordered not to have any contact with the victim or his family.
