$3.1 million decision stands on Nemer property

A Summit County probate court judge this afternoon denied a request from the University of Akron to retry a case awarding $3.1 million to campus property owners.

Judge Bill Spicer also declined to lower the amount of the verdicts.

The university will have 30 days to appeal to the 9th District Court of Appeals.

UA is seeking the properties — by eminent domain — to build a 450-bed residence hall.

The jury determined the university should pay $2.1 million to Joseph and Mona Nemer for their property and $1 million to Joseph and Mona Nemer and Manny and Colette Nemer for a parking lot they own jointly. All of the property is on East Exchange Street.

Spicer has yet to reschedule the date for Manny and Colette Nemer's trial.

University officials have said they planned to spend $5 million to acquire the property for a stadium and residence hall and already have exceeded that amount.
