Ohio court strikes down ban on guns in parks

COLUMBUS: The Ohio Supreme Court has struck down a law in the city of Clyde that banned people from carrying concealed guns in a public park.

In a 4-3 decision announced today, the high court said the city ordinance conflicts with Ohio's concealed carry law. The court rejected Clyde's claim that the city was exercising its home-rule powers.

The city was sued by the group Ohioans for Concealed Carry, which argued parks are prime spots for criminals and that visitors ought to be able to protect themselves.

The state Legislature in 2006 passed a concealed weapons law stripping local governments of the authority to pass tougher gun laws than the state law, which bans concealed weapons from most public buildings, including stadiums and arenas but not parks.

Clyde is about 40 miles southeast of Toledo.

Interesting. Why is it that universities can ban guns from their property, but not a city park? I thought I had read that places like the University of Akron don't allow concealed weapons on campus? Or is that maybe just in the buildings. Either way, college campuses seem to have a lot of crime, and if somebody owned a gun for protection why wouldn't they be allowed to carry it to class, in their dorm, and all around campus?

So, home rule is the law except when the Supreme Court says it's not the law. Which means, a law is a law until the outlaws buy enough seats on the Ohio Supreme Court to have the law over-ruled. Sound familiar?

The university restriction is written right into the state law I believe, since all universities ban guns in Ohio.

Only the twenty five percent of We the stupid, defiant of demands of natural law (what Mother Nature, God, or Whatever Power decreed to be the reality of the real world) God, democracy, capitalism, the US Constitution, and free, fair, and affordable commerce. Deceived in Sunday schools, public schools, private schools, and home schools, colleges, and universities government of the people, by the people, for the people, believe criminals will comply with this no carrying guns in parks law?

"College campuses seem to have a lot of crime?" Any facts to back that up? Or are you just guessing that if a student whips out his gloc, it will prevent someone from taking the iPod off his desk. Better yet, throw in a more violent crime and what happens when the student panics and hits someone walking to class instead? Let's leave guns in public to the professionals, say... cops for instance.

What we need is a lot more guns. And we need them everywhere anyone goes. Banks, bars, schools, day care,....they all need guns. Lots and lots of guns. Because, as we know, guns are not responsible for anything bad. Nothing. They're just like cell phones or PDA's. It's the users of guns who are sometimes bad...just like cigarettes, themselves, are not bad, just the users. Criminy...the insanity is overwhelming at times.

If a student at Va Tech had been legally packing heat, most likely many lives would have been spared. But Va Tech was a Gun Free zone. It sure kept the assailant from bringing guns on campus eh?

Thank God the Ohio Supreme Court understands that cities should not be aloud to take away our Second Amendment Rights. The Right to Keep and Bear Arms shall not be infringed! This is a victory for the American way! I am licensed to carry and I do every where I go. How many people have been hurt? Zero! It is not law abiding citizens that commit crimes. Criminals commit crimes and they will not follow laws by cities to not carry in the park or anywhere else! Here's a newsflash for all the liberals who are hoplophobic . . . Criminals do not follow the law! Making areas no gun zones equals making them "criminal protection zones" since only the law abiding will not carry. The criminals will laugh and carry them anyway! American Citizens have a right to self defense and there are still many of us who want to exercise that right! Remember . . . when seconds count, the police will be there in minutes!
