CANTON: A preliminary hearing has been scheduled for Oct. 16 in Canton Municipal Court for William D. Perry, the North Canton man charged with vandalizing the electric meter of a neighbor who was found beheaded Saturday.Judge Mary Falvey continued the suspect's $150,000 bond this morning and barred anyone from interviewing Perry ''regarding the above case or any other criminal matter that may be under investigation.''
Defense attorneys Tony Koukoutas and Rick Pitinii had sought the order to prevent the North Canton Police Department from questioning Perry about the death of Brett W. Smith without the attorneys being present.
Smith, 34, lived one block away from Perry in the Evergreen Mobile Home Complex off Main Street in North Canton. Smith's headless body was discovered by his mother, Judy Smith of Hartville, in the bathroom of his mobile home shortly after 7 p.m. Saturday. Smith's head was found later in the trailer.
Koukoutas said they would consider requesting a reduction in bond, which he said is unusually high for felony-5 vandalism charge.
''At this moment in time, we can't comment on that,'' Koukoutas said. ''It's the court's discretion on setting the bond.''
Pitinii was more to the point when asked if he thought Perry was a suspect in Smith's death, which was ruled a homicide by North Canton police on Tuesday.
''If he [Perry] wasn't a suspect, they wouldn't have him in jail on a $150,000 bond on an F-5,'' Pitinii said.
