Condemned killer Richard Wade Cooey says prison food is partly responsible for making him too fat to be executed humanely.
Cooey is scheduled to die by lethal injection Oct. 14 for killing two University of Akron students in 1986.
His attorneys said in a brief filed Tuesday in the 6th U.S. Circuit Court of Appeals in Cincinnati that the state is partly responsible for Cooey's physical problems that might make his death unnecessarily painful.
The appeal says his obesity could make it difficult for the execution team to find a viable vein for lethal injection.
Lawyers also repeated another claim that headache medication prescribed by state doctors could reduce the effectiveness of an anesthetic administered during execution.
State attorneys argue that all of Cooey's claims are invalid because he missed an earlier deadline for filing appeals.
Cooey, 41, is being housed on death row in the Ohio State Penitentiary in Youngstown.
Cooey was a 19-year-old Army private home on leave and partying with friends when he and a friend kidnapped, robbed, raped and bludgeoned Dawn McCreery 20, and Wendy Offredo, 21, in September 1986.
Cooey has blamed co-defendant Clint Dickens for bludgeoning the women. Dickens was 17 at the time of the murders and was sentenced to life in prison.

Its obvious that the prison food isn't that bad if he hogged it all down and gained all that weight no ones fault but his own. At least we now know prisoners are getting fed well, probably better than most people.
The only pain and suffering I see in this case is of the two girls and their families. Justice will be served as soon as that needle is injected, its been a long time coming.

Lets take a vote here, since we are in the voting mood right now, who thinks this idiot should be put before a firing squad so he won't be afraid that the system will make him uncomfortable trying to find his stupid veins? I don't think he was too worried about how uncomfortable his victims were when he was beating the crap out of them. I don't feel one bit of pitty for this animal and how much pain he will be in when they put him to death. His death could not be soon enough for me. I am tired of looking at his stupid face in the paper and hearing about how fat he is getting on my tax money. He should have been put to death years ago!!

I feel sorry for the family. They man should be put down, like the animal he is. Stop giving him food, and start an IV diet only so the vein will be ready for him.

If he's afraid of not finding a vein- Why not just bludgeon him to death, two people doing it at a time to represent each girl.

give him a wiff of "laughing gas" and when he's out--go poking around for the vein to let the drugs work!! I know people "bigger" than he is and they give blood and have no problem with nurses and doctors finding veins on them. Give it up Cooley--atleast you get to say good-bye to your famliy. And for all you bleeding heart people that claim that this is a in-human way to die--just remember all the victims and how the pain they went though and their families and friends
