Landowners settle with UA

After more than a year of negotiations and hours shy of a jury trial, the University of Akron reached a settlement today to purchase land owned by Manuel and Colette Nemer.

UA agreed to pay $1.8 million for the Nemers' commercial property on East Exchange Street, the couple's attorney, Russell Smith, said.

The university also agreed not to file for eminent domain for at least 15 years on three other parcels the Nemers bought on Brown and Wheeler streets where they will relocate their businesses.

''The most important thing to Manny was keeping in business,'' Smith said. ''I'm hoping they never touch them'' at their new location.

UA spokesman Ken Torisky declined to comment until contracts had been signed.

The settlement is about $300,000 less than Manny Nemer's cousin, Joe Nemer, and his wife, Mona, received from UA in September for similar property.

Smith said Manny and Colette Nemer's settlement was satisfactory.

''I think the settlement is appropriate, but I don't think it's a roaring victory for either side,'' he said.

''The settlement started out at $900,000, so that part of it is good. I do think in the real world and in Manny and Colette's life, the most important thing will be that they stay in business.''

The settlement includes lawyer and relocation fees and payment for Manny and Colette's share of a parking lot on East Exchange Street that they shared with Joe and Mona Nemer.

Manny Nemer could not be reached for comment.

Manny and Colette Nemer will be allowed to operate their two businesses — Manny's Pub and Aroma Coffee and Tea — until March 1, Smith said. They also lease space to Chopstix restaurant.

Summit County Probate Court was poised to start seating a jury this morning when the parties reached a settlement.

I predicted this months ago when his cousin settled. I knew this was coming. They're right they're no winners in this. After you subtract the lawyers fees and court cost from the 1.8 mil. Manny comes out with about what UofA offered or he could have negotiated in good faith in the first place.

Hey ron did pluquellic promise you a raise? 15 years is long enough for strickland to apoint a bunch of new University Directors to the point of forgetting about it.
