Tenant files suit against Falls complex

A confrontation at an apartment complex in Cuyahoga Falls has prompted a tenant to file a discrimination suit against OLJ Management out of Columbus.

The suit, filed by the Fair Housing Advocates Association, charges that a manager used a German shepherd to harass and intimidate African-American children living at the apartment complex.

The teens told housing advocates that the manager cursed at them and confronted them with the dog.

''Given the racial history of our country, her actions were definitely inappropriate,'' said Vincent Curry, executive director of Fair Housing.

The manager, Kim Meyers, 43, who is white, said she brought the dog to work for protection. She said children at the complex have trampled flower beds, thrown rocks on the roof and vandalized picnic tables.

''Things are not out of control, I just want people to follow the rules,'' said Meyers, who has managed Pleasant Meadow Village complex on Pleasant Meadow Boulevard for just over a year.

Meyers said she received two calls within 15 minutes on July 15 of unruly behavior at the apartments — one for a broken window and one for kids climbing in trees.

Meyers said she called police and went to the apartments with her dog.

She said she walked around the complex with her dog and waited for officers to arrive.

Falls police have no record of the incident. Police records document 18 incidents since Meyers has been manager. They range from trespassing to loitering to threats among tenants.

Meyers said when she brought her dog last month, she confronted about 10 children ''of all sizes, all ages and all races.''

Meyers said she receives constant complaints from tenants that they are intimidated by large groups of teenagers. About 35 children reside at the 75-unit complex that caters to low-income residents.

''I had the dog on a leash. I know a lot of people are afraid of dogs, but Taz was not barking and was not lashing out,'' Meyers said. ''I told them if they were afraid of the dog, then stay away, don't tease him and don't taunt him.''

She said her dog is about 10 years old and is not aggressive.

Tenant Nicole Tatum, 31, who filed the complaint, said she was standing in her doorway watching the children.

''I saw the manager approach the children with the dog,'' Tatum said. ''I stepped outside, but didn't say anything. I just observed.''

She said the manager then accused her daughter of climbing in the trees. A verbal confrontation ensued.

''I told her I didn't appreciate her cursing at the children, disregarding their feelings about their fear of the dog and trying to confront my daughter when I'm standing right here,'' Tatum said.

Meyers said she gave Tatum a violation letter for breaking the rules of the lease contract.

''I wrote her up basically for disorderly conduct, she was yelling and disturbing the peace,'' Meyers said, adding she noted in the violation that the little girl had climbed a tree.

Four violations can result in eviction from the complex.

''I have no problem with rules, but I want them enforced for everybody, not just randomly picking on African-American kids accusing them of doing things with no firsthand knowledge,'' Tatum said of her first violation. ''I feel it's retaliation because I spoke up.''

Tatum said she has lived in the complex for about a year.

''Everyone got along and my kids had many white friends,'' she said. ''I teach my kids to respect other people and to look at people, like people, not by color.''

Meyers said she plans to implement additional rules that will discourage children from congregating at the complex, including a ban on playing in the parking lot.

Meyers said she also plans to set up a neighborhood crime watch.

''I don't like drama,'' Meyers said. ''I'm responsible for the people who live here, their safety and well-being. I take my job very seriously.''

The complaint filed against the complex will be reviewed by the U.S. Department of Housing and Urban Development.

I think we all knew that development was gonna be trouble from the moment it was proposed. People living in an apartment/condo complex like that need to learn the first rule: You are in an enclosed environment, and must respect the privacy and right to peace-and-quiet of every other person living there.

35 kids in 75 units? Sounds like the place is overrun with kids. I'd get the rules enforced and get the riff-raff out of there. It's time today's youth learn some manners and decency.

At 43 I doubt she is old enough to remember this part (about dogs) of civil rights history, and I doubly doubt that she would have learned this in high school. Don't most police departments have a canine unit?

If the parents were outside with there children like they should be making them follow the rules instead of in the house or doorway watching them then they would know what there kids are doing but since they were't then please don't play the race card that is so old.

Well Mr. Obama why don't we build more low income housing for our ever-increasing dependants? We have hit a new threshold in this Country, 35 million people now collect food stamps - not because everyone has loss their job en mass but because Obama and his administration has lowered the standards to receive gov't assistance. Little Johnny isn't going to get a job because why should he have to? "Lets just suck off the gov't teat like mommy". We cannot keep up this cradle to grave mentality - it is bankrupting European Countries and setting up generations of losers.

I am so sick of every time a black person gets in trouble,it is the "race" card.!!! This is just a convenient excuse for them. Get real, face the facts, this has nothing to do with race...it has everything to do with the fact this woman has no control of her kid!!!!!!!! Her daughter is nothing more than another deduction on her taxes (oh wait, she pays no taxes!!!!!) she is a dependent for additional welfare money.

@Gildee: There are no other neighbors, except the ones that live in this complex. Pleasant meadows is in an isolated part of Cuyahoga Falls, off Wyoga Lake rd. All the unruley kids live in THAT ghettoplex.

since when is climbing a tree 'unruly' behavior.

People say kids are getting obese they needs to go outside and play, then when they go outside and climb trees that type of behavior is seen as unruly. Seriously folks, come on now.


Mind you, I don't condone trampling flower beds, breaking windows and the likes, but a tree is a tree is a tree. A kid or young adult isn't going to hurt it by climbing it. A tree isn't going to be destroyed if someone swings form a branch.

You would think we would rather see children playing in trees than creating chaos. This manager appears to believe the opposite and by going and yelling at the kids most likely just sparked greater rebellion in them.

How is this racial? So its ok for 40 black kids to beat up a white family but its not ok for a white person to bring their dog to work for protection against the unruley black kids. And why hasn't there been anything in the paper about the 35 black kids from Akron that were at Rockin on the River Friday night and were beating up on one white kid. I suppose this will get pushed under the rug also.

Sick of the 'race card'? Try being one of THREE white students in a Constitutional Law class. THAT was exciting.

The way I see it is, that is how the majority of the kids are.....anywhere. Doesn't matter if it's a complex or not. There is "white trash" and there is "black trash". You are who you make yourself out to be. The kids are guided (or lack thereof)by their parents. i guess a lot of people do not care how they are perceived by others.
Follow the Golden Rule-treat others how you would like to be treated.

By the way. In Bridgeport OH and Barnsville OH they
have elderly housing run By a National Church Residence's and their manager has servealence camera's all over the building and he threatens
them with eviction if anyone complains about anything. No suit has been filed against this man,
but National Church Residences has been notified
about him and they think he's great. There is a National Church Residence in Cuyahoga Falls too,
so if the people at the other place arent content, they can put in application at Nationa Church Residence.

National Church Residence is the Cathedral Lane Complex owned by "The Cathedral"... I have talked to several Police Officers and area residence and the amount of drugs going through that building is astounding. It was built as a Christian home for the elderly, like many other complexes, when that demographic couldn't afford it anymore, the management opened it to low income qualified residents with all their problems (ie: drugs, crime, fights, etc). Sad how a few people ruin it for everyone.

The residents need to remember it is NOT their property, and they are to respect the management rules. The trees are too thin to climb without damaging them. Kids play everywhere w/o breaking windows. It is called RESPECT. These moms need to teach this to their children.

These sec.8 queens are lucky they found someone willing to rent to them, I own rentals and I learned my lesson and no longer even consider it just for this reason, the moms let the kids terrorize the neighborhood,period.

Sounds like a similar bunch of teen animals who now live in apartments in a suburb (Sec8), who were at a nice quiet park yelling obscenities, yelling at white moms telling them what they would like to do to them, commenting on various parts of their anatomy, etc. All this while little kids were playing around them. Don't have the common sense of a toad.

Lawsuits like this one detract from the truly egregious situations for which this type of tort exists.

I highly doubt that those kids were alive when dogs were being used in Mississippi, nor were there 31 yr old parent(s), so the "racial history of our country" ought have no bearing on the situation. What a crock.

Now, if she was threatening to sick the dog on the kids, or only reprimanding black kids with the dog present when white kids were misbehaving too, that would be different, but I must have missed that part of the story.

Gildee, she is not that old. She is in my age range, and I never, ever learned about this in school. Teaching black history to predominately white students is a relatively new concept, trust me. At 43 she was just BORN in 1966!

Ambulance chasing scumbags! They sue, knowing that most businesses will settle before a trial ever happens. It is cheaper than actually winning the suit, which they would, if the case made it that far.

If you want the kids to not congregate in a certain area, you can install those devices that emit a frequency that only kids can hear, and it drives them crazy. They can't stand it. Adults can't hear it. I'm not sure how it works on the so-called adults who act like children while raising them.

If you can't afford these devices, just put speakers in the window and play some country music. Preferably some David Alan Coe, Merle Haggard, or Hank Williams (Sr. or Jr.). It is like krptonite to young urbanites.

I don't want to hear the words "race" and "inappropriate" until some resolution is brought about in the 4th of July case in Firestone Park. Especially not in the form of some payday lawsuit like this one. You'd better hope I'm not on the jury, lady.

The comments that are made on this site are ingorant and hurtful. There are probably more details to this story that are not being mentioned. Cuyahoga Falls haaas a history of being intolerant of those who are not caucasion. Blacks and whites live in subsidized housing, receive food stamps and are on welfare. It is ridiculous to assume that the parents of these children are "poor parents". It sounds like these children were doing things that ALL children do. I am an African American female. It is very sad to think that the people on this site making ignorant comments are probably my neighbors or the parents of children who go to school with my children. This world has become a scary place. Tonight I will pray that everyone finds peace and self-acceptance. God will bless you all.

Use Common Sense-You hit the nail on the head !

Complex manager should buy a loudspeaker system and play Aretha Franklin singing R-E-S-P-E-C-T every half hour loud enough to disturb the parents naps and Soaps while the kids are on the loose,bored with nothing to do.

Hey maybe they could buy a summer pass to the swimming pool,or load them up and take them to Portage Lakes State Park to swim or go fishing to burn off some steam !

Dumb and Dumber-- Race card,Bad manager,& Bad Kids.
This situation and all of the comments are a true reflections of bad leadership. The right thing to do; For the manager resend a notification to all the tenants about the rules. Not using the dog for protection. Asking all of the parents to help enforce the rules instead of the finding a way to say it is a Blacks,poor, or poverty issues. When rent is being paid for housing.

To all my bruthers from another mothers...
Oldest situation known to man, unsupervised youngsters congregating with mob mentality.
These is not little Johny and Susie burning off a little energy climbing trees but a large group of hard eyed and out of control youngsters who know that mommy will come out swinging regardless what they are accused of doing.
Instead of a good arse-kick they will be made into pooor victims with possibility of winning the ghetto lottery.
Sixties racial stereotypes aside,a dog is a common deterent to crime and this one was non-agressive.
The manager should just hand out eviction notices to the offending youngsters to take home,the waiting list for needy folks to move to the Falls is miles long.

ANZ, thanks, I own my home and understand that if a stranger falls on my property they can sue, that is also what insurance is for. But having been a kid who climbed LOTS of trees growing up I never did any serious damage falling out of any of them

To those who explained the age of the trees is part of the factor, thanks. I don't live in that area and wouldn't think of climbing what sounds like are essentially saplings (sp?) even when I was younger.

It is sad to see where the Falls has gone, in the past few years. I know quite a few good families that have moved out to more rural areas, due to the "diversity" problems, and to get their kids into demographically better schools. A few of them have taken massive losses on their homes just so they could get out. The Riverfront Mall used to be a nice place to go on a weekend. Now, it looks like a refugee camp. More cities need to start fighting HUD, Section 8, and "slumlords".

Quit acting all hurt and surprised that just maybe there are people living around you and going to school with your kids, that aren't quite as eager about being around you, as you might hope. It can get much worse. This city only reports crimes and nuisances from parcels they want to eminent domain or tear down so a crony can buy it. You'll NEVER see a police report regarding the Rockin' complex. The only complaint ever filed about the riverfront was when David Allen Coe cussed too much. There is a fight there almost every weekend.

I believe a new manager was picked who would be tougher. There have been many incidents in surrounding neighborhoods. A lot of these neighboring folks were happy about a manager who would make it a priority to enforce the rules.

I think it was OK for her to remind the kids of the rules that the parents obviously did not. How could she be standing in the doorway watching her daughter climb the tree and not tell her to get off? Like many of the other post that know the area those trees are new and cannot hold any child of any age!! The manager should send a letter to the parent and use the 3 strikes rule, 3rd letter they go!!

There is a simple solution to this...
1) Install cameras in "restricted" areas.
2) When the tenenants(or their kids) break the rules, cite them(preferably with "rental-comunity service)
list of chores would be;
repairing damages, cleaning up trash, planting flowers, trees, etc.

sooner or later, the parents will tire of this and eigther rein in their wild kids, or move out.

I didn't read the mother denying that her kid was breaking the rules that she agreed to when she signed a lease.

Somebody said that they wouldn't try climbing a sapling as a kid. Maybe these kids don't care, it isn't there stuff. Their parents don't tell them the rules, or enforce the rules.

I agree that it is a disgrace to real civil rights violations that these kind of things happen. The lady took a dog with her for protection when she went around the complex to check out the problems. She didn't have the dog attack or intimidate anybody.

But the mother, typical of many in society today (of all races, social status etc) that never think their kid would do something wrong. If one my adult neighbors told our parents something about us, the adult was believed, and we were punished. Of course us kids wouldn't admit to the wrong doing, but I parents could tell we were not being honest.

I just wish to take the oppurtunity to address some of the ignorant statements posted. I too at one time lived in govt. housing in Tallmadge and let me tell you from the time I began living there I worked and sat around and watched many whites and blacks do nothing but collect the money and stamps. There was definitly racism present there, but however I was taught to respect others, and all things so therefore I taught my children the same and still continue to this day. However there are alot of things that go in the suburbs that don't get mentioned and I can tell you alot, so lets not think that just black people are trouble because believe you me your people can bring on alot as well. Instead of her sitting back and watching the situation, yes she should have come outside and spoke with the manager first and talked with her child right then and there about what is expected of her etc. All I'm saying is please don't group all apples in one basket because of a few bads one because both of my boys have graduated from high school and on there way to college, and my daughter is doing quite well is school also...and one more thing I did this all without there father!!!

This manager should be given a pass. The dog attacked no one. How could she know if these kids were like the gang in Firestone Park or not? She does have a right to protect herself.

One possible solution in time:

All persons receiving public assistance because they dropped an anchor baby or dropped a baby they knew they could not afford or generations raised on welfare, should be sterilized after the first child. If they will not go through the procedure then no public assistance. This will reduce the problems associated with having a large, poor population via attrition.

That said there is a time when the program will need to be suspended.

My interpretation of this news report: New manager trying to enforce pre-existing rules which previous manager did not enforce. Tenants have established behaviors and are resistant to change and rules. Race is not the issue - proper behavior is the issue. I found the following review of Pleasant Meadows at: http://www.apartmentreviews.net/ratings/ohio/cuyahoga-falls/pleasant-meadows-village-r75296.htm . I found it very enlightening. Name: Anonymous. Review Date: 6/3/2009. Rented: From 2005 To 2009. i lived in these apartments from 05 until 09. there is nothing "pleasant" about living there period. the place is turning into a ghetto if you will. you never have the same neighbors. they can't keep tenants there for nothing. the ONLY reason i stayed there was because of the size and school district. during those years there was at least three different managers, five or more maintenance guys (who only worked like a couple hours a day) doing what nobody actually knows. i know of plenty of people including myself that when things need fixed they DO NOT get done. IF it does it takes forever. i know someone who lives there currently and there bathtub does not stop running and and there ceiling leaks, it ruined their furniture and the management wont do anything. peoples apartments get broken into. if you leave anything outside it WILL get stolen. the little kids ages as low as 4 say worse words than what i say as an adult. little kids fight all the time out there. there is NO parent supervision outside. so kids think anything goes. there is plenty of grass for the kids to play in but they think they need to play in the parking lot throwing balls riding bikes...while at the same time everything is hitting peoples cars. pleasant meadow does not care about anyone. and you can never get a hold of anyone!!! GRRRR i could go on forever but i got out of there for a reason....to forget about that place forever. so good luck to anyone who lives there or is moving there.

Additional comments: The property manager needs to send all tenants a copy of their signed leases, the housing complex rules and the consequences of not respecting and abiding by those rules, the parent or parents need to supervise their children, the parent or parents need to be good role models for their child or children, and the Cuyahoga Falls Mayor and City Council need to address the teen crime issues in the city, e.g. the Rockin' on the River and Pleasant Meadows incidents. Ignoring the issue will only increase its likelihood, not lessen its occurrence. I have been a resident for several years and have seen many negative changes in Cuyahoga Falls; increased teen crime is only one of the issues.

I keep hearing that this place is called Caucasian Falls, Is there something you need to tell me?
Is there racial stuff going on?

Thunder 31 please write to me I am doing a research paper on racism, but I really do not see why C Falls is/was called Caucasian Falls. That's a little weird
