LAKEMORE: His mother had died unexpectedly, he avoided the pills that helped combat his depression, and just this week, his wife left him.
Daniel Tice's emotions boiled over Thursday afternoon when his wife, Brandi, came to pick up their three children, a day after announcing her intention to divorce.
Brandi Tice, 28, would never leave the Lakemore house. She died of a single gunshot wound to the head — a rifle shot that police say was fired by her estranged husband.
About seven hours later, after keeping SWAT officers at bay with his 4-year-old son by his side, Daniel Tice was shot by police, struck by a 9 mm bullet that miraculously bounced off his forehead, sparing his life.
Tice, 32, was to undergo surgery Friday for a fractured skull. He is expected to recover and be charged with murder.
Daniel Tice admitted in conversations to family, friends and police that he killed his wife of eight years, shooting her once in the head with a .22-caliber rifle, police said.
He blamed infidelity and divorce.
''[Brandi Tice] told me before she was wanting to leave him and I said be careful because of his mom dying, [Daniel] was bomb,'' family friend Janice Wood told police in a taped call. ''I was afraid something would happen.'
Wood, a close friend of Tice's late mother Diana, told police that Daniel Tice called her after the shooting. Around the same time, police were surrounding his home.
''He said he killed his wife,'' Wood said. ''He thought everybody was against him or hated him . . . he said, 'I'm not coming out [of the house]. They're going to have to kill me.' ''
Daniel Tice made a series of phone calls that afternoon, including one to a sister who came to the Tices' ranch-style home on Martha Avenue shortly after 3 p.m., saw Brandi Tice's body on the living room floor and fled outside.
Tice's brother-in-law struggled for the rifle outside the home, but the towering Daniel Tice won out, and retreated back inside.
At one point, Tice stood guard by a window with his rifle in one hand and his son, Noah, in the other, police said.
Shortly afterward, Tice's daughters, Faith, 8, and Grace, 7, exited their school bus and were met by police, who rushed the girls away before they could go inside their home.
Stressful standoff For the next seven-plus hours, police took over Martha Avenue, trying to coax Tice into surrendering and hoping to avoid more bloodshed. Lakemore Mayor Michael Kolomichuk gave the order to use deadly force on Daniel Tice, if necessary.
A small army of SWAT officers, talking by phone to Tice, crept closer over several hours — from the street, to the front door, to the living room and eventually to the basement stairs, where Tice paced below with his son.
The silence was sometimes unnerving to police, who feared little Noah was dead. As the night dragged, they hadn't heard from the child and Tice was talking to police in past tense about how much he loved his son.
''We were worried that he had done something to Noah because he wouldn't let us talk to the child,'' Police Chief Kenneth Ray said.
Police eventually disconnected a land line into the Tice home and with the help of prosecutors, they cut off Tice's cell phone. Negotiators then moved inside the house to bring Tice a cell phone.
By then, Tice had moved to the cover of the basement, at times hiding under the staircase. Metro SWAT members tossed a miniature camera to the basement, which gave them insights into Tice's location.
Around 10:40 p.m., SWAT snipers from the top of the steps could see Tice and his rifle leaning against a wall out of reach. They fired two nonlethal bean bags, hoping to knock him to the floor. The bean bags didn't faze Tice, who then made a move for his rifle, police said.
A sniper tried to fire his AR-15 assault rifle, but the trigger jammed. A second SWAT sniper twice fired his MP5 assault rifle. One shot missed; another struck Tice's forehead, penetrating to the bone and bouncing off.
Suspect interviewed Police interviewed Daniel Tice at Akron City Hospital shortly after he was shot.
''He confessed, that's all he did,'' Chief Ray said. ''He didn't give a reason. He just said he did it.''
Noah was reunited with his sisters. The children are staying with Brandi Tice's mother, Sandra Fox, 53, in Green.
''She was a good mother, she loved her kids so much,'' said Brandi Tice's uncle, Randy Renard.
The Tices spent Christmas with Renard and other family members at Sandra Fox's home. The get-together came four days after Daniel Tice's mother died.
Daniel Tice, who family said suffers from bipolar disorder, said little on Christmas Day. Family and police said Tice stopped taking his medication, which contributed to his erratic behavior.
''They brought the kids over for Christmas and I already heard what he was going through with his mother,'' Renard said. ''He come over and he didn't talk for four hours. He just sat in the chair with a stare.''
On Wednesday, Brandi Tice told her husband she wanted a divorce and was taking the children, Renard said. Police said the couple had a history of domestic squabbles, some of which ended with Daniel Tice's arrest.
Daniel Tice also told friends that his wife was carrying on an affair with one of his relatives. The couple married in 2000.
On Thursday afternoon, Brandi Tice arrived at the Martha Avenue home, planning to take her daughters with her as they exited their school bus.
Brandi Tice worked the past four years with Community Caregivers, a Hartville home health care provider. She visited three or four patients every day, helping them with health needs.
Terry Smith, the company's director, said Brandi Tice grew close with her patients, whom she would visit for more than two hours a day, passing the time sharing stories and proudly showing pictures of her children.
She hoped one day to be a nurse to better provide for her family, he said. The company has set up a fund at all Huntington bank branches to help the Tice children.
''Brandi was somebody who had been through some bumps in the road, some hard knocks,'' Smith said. ''Yet she was someone who gave so much even though she had so little herself.''

I knew Dan, so I will make this short. I am so filled with sorrow right now. I can not believe he did what he did. The Dan i knew didnt have it in him and i dont like the picture the media is painting of him. But Dan did comit the crime and should pay the price, but before everyone says he always was a monster in this world, your wrong. Good people make Bad choices everyday, and they will be condemed by the right procedures. My heart goes out to the three wonderful children that are the true victims here. Nothing in this world is worth a life. God still loves you Dan and he will look after your kids. its nerver to late to repent.

That is frightening that this happened not 1/2 mile from my own home. I was at home when this came on the news live.
I agree with awl, when drastic things happen, people don't think, especially if they are bi-polar, or manic depressive, or have any kind of mental illness. But he did what he did and now he should be punished accordingly. Thank God nothing happened to that little boy or those girls.

Why did it take SWAT over 8 hours? When they could of had Mayor Bully just run through the door. Het SWAT next time kill the person, us taxpayers are tired of supporting criminals forever. Then again this is Ohio.

Why did the mayor give the order for the police to use deadly force??? What does he/she know about law enforcement?
Mental illness needs to be taken more seriously. The law needs to make it easier for someone like this to get help-have help forced upon him if necessary.

It may not have been all him but, sorry, she is not the one that pulled out a rifle and shot him in front of their 4 year old. Being a mom of a 3 year old, my son has enough sense at his age to know what is going on and if something were to happen to his mother, he would know something is terribly wrong. Poor Noah is now going to have this with him for the rest of his life. Daniel was the one that made the decision to take BOTH parents away from those children that day..NOT Brandi..Families can get through a divorce, those kids would have still had their parents at least. He's a murderer, mental illness or not, and he deserves everything he gets. I'm praying for these poor children, I knew all 3 of them and Brandi, my heart goes out to all of you!

Where are the other 21 shots? The beanbags didn't work, right? So where are the other 21 shots? Jeff Stephens did not point his gun at police and he sure as hell didn't kill anybody or hold anyone hostage, but a white man can do all of this and they use beanbags to try to control him? Jeff was nowhere near the size of Mr. Tice. I am suggesting that Marco and Don come together and ask for donations to purchase beanbags for the "African-Americans" too.

Mental Illness or not this guy killed somebody and had a 4 year old boy inside with him. Had the child not been inside i'm sure they would have gone in and lit him up as he deserved. I think they waited 8 hours because they were trying to make sure the boy didn't get hurt.

I recently attended a meeting of a group I belong to, where a guest speaker was featured. The speaker mentioned during his talk that he had been diagnosed with bipolar disorder, and was doing well on his meds. He asked for a show of hands of people in the audience who shared his malady, and I would say that in a room comprising about 150 people, roughly 30 or more folks raised their hand. I was both dumfounded, and highly skeptical. Personally, I believe that our society has been conditioned to slap a convenient lable on people who may just plain have a hard time dealing with the (sometimes tragic)everyday ups and downs that are just a part of life as we know it here on this planet.

Who is the real victim? There are four victims,Brandi and her three children.Brandi and I have been close friends for three years, and she had endured Daniel's unimaginable attacks of violence. Brandi finally got the courage to set herself free, and Daniel murdered her. Any man that would shoot the mother of his children in front of them is a monster and deserves the same death sentence that he imposed on Brandi.

It is hard to deal with a person that is bi-polar; I know from experience. They make up things in their own head and believe them to be true and if you tell them they are wrong they think you are lying to them. They live in their own little world and believe everyone is against them. So sorry this has happened and God bless those children and hope they don't have it either as it is hereditary.

I'm sure that the mayor was consulted and gave his OK and did not make the decision to take this guy out all by himself. In my opinion, he had no other choice. He did what was right and best for the child. This guy has big city mayor written all over him, why is he wistinh his time in a small town village. Maybe he's setting himself up for a run at the senate or house. Hell, I'd vote for him in a second. He's just what this country needs.. a dose of "No B.S." with a get it done attitude. God bless the entire family. Something those kids will live with forever while a cheating wife ends up like a ... Dan deserved better that a lifetime in jail. Sad times ahead for the kids...

Regardless of what itch she had where, she didn't deserve to die--at the hands of her husband and especially in front of her kids.
But I do find it extremely noteworthy how men can stick a label like "tramp" on a woman for sleeping with someone else, and when a man does it, well--he's a man. Pahleeze.
Don't be so quick to name-call or judge. None of us walked in her shoes with that man. Some of us know what she endured with him. Quite frankly, I can't say I wouldn't eventually turn to someone else over years of physical abuse either.
But that's not the issue here. He could have actually perceived her behavior as someone who was cheating--maybe she was, maybe she wasn't. Daniel apparently had issues--he could very well have made a mistake in his judgement of Brandi.
My point is: Don't be so quick to judge.
This is a tragedy--brought on by circumstances beyond anyone's control.

The only bad part of this seperation that was about to occure, he was to loose everything. DR court would take all his money, throw him out of house and allow the children to be taken from him and she was the one who messed around. He did nothing wrong. He was a model citizen for 8 years of marrage and he was to loose everything. Most men know when you go to John Quinns Court or Carole Dezos court you loose everything because you are a man. You can watch you children slip from good kids to unruley kids due to the mother not doing her job and the court will do nothing. You can have the children tortured in a closet in Summit County and the Magistrates in Quinns court will not listen to the complaints. They will try to jail you because you complained your kids were being tortured, see ABJ kenmore 6 if you already forgot.
I do not like this type of action how ever this is the 2nd time this has happend in 2 weeks, one time in CA and now here. This is what you get when you cant get justice in courts. If people are going to be jailed, ie taking all money, eviction from house, take children out of town or not follow visitation orders why not be in a jail that WE PAY FOR.
We have the divorce business, woman biased DR Court and biased prosecutor Walsh to thank for this in Summit County.
Men are more than a money tree. We do good with kids. I know I did and continue with my grandchildren.
Again I do not condone this type of action. This is not good for the children however I do understand the logic. He had nothing to loose... DR court and Prosecutors office would make sure she got it all.

First of all David, there is never a reason for killing. Secondly, from what I understand, she was planning on leaving the State with the kids, and that is unlawful.
This is the Beacon reporting this story, so I do not believe for one minute we are getting the whole story.

As far as DR Court, ..all the courts are corrupt. One judge even ruled that the United States Constitution did not apply in his court. WHAT? You mean, he said he was above the law? YEP. Happens every day. Look up cases on paying Federal Income Tax if you don't believe me. Find the Amendment that says you are required to pay Federal Income Tax. You won't--because there isn't one. It was actually outlawed in the early 1900's. Yet, we sheep blindly pay it and never question the system. The courts ALL need an attitude adjustment.
But for Heaven's sake..
Please don't be so quick to judge Brandi by what Daniel said. There are always two sides to the story.

david, Check out summit county clerk of courts, no way was he a model citizen for 8 years, read for yourself. Also, no matter what his wife did, it isn't and wasn't a reason to kill her, and hold his son hostage. Divorce and affairs happen all the time(not that I condone it), but real men suck it up, and go on with life, as painful as it may be. They don't do what he has done. Also real men take their medicine 9f they have a mental illnes, because they know it is the right thing to do, and they are mature enough to figure it out.

This is my first time posting on the site and wanted to give my prayers and support to the children, and family. I read the comments posted on this site all the time and there is so much one could say about the comments everyone makes. It's amazing what people will say, use for their agenda, rant and rave with know thought or care for the family of the victim or perpatrator. Im not writing this comment to single anyone out or to humaliate or belittle anyone. What this man did was wrong very wrong and he should be punished, that is for sure but what i havent heard is about the children what happens to these poor souls? Know one has said anything about that. Too much goes on here about black or white, we all bleed the same color RED we all (for the most part) try to live good lives and better ourselves. While murder is bad, of course, duh!, I don't think any of you who are judging this guy have ever been confronted with a cheater before. If you have, you would know that for a very short period of time, your brain can just collapse and JUSTIFY about any action you do in a certain time frame. It's a temporary mental illness, like being shell-shocked to some extent. I bet more than half the murders in the WORLD occur because of someone just losing it for like 10 minutes. ANY of you out there are capable of doing the same things if you're confronted with the right information. We're humans, and no matter how mature you may think you are, if you walk into your house and see someone having sex with your wife/husband, the thought WILL cross your mind at light speed. In that one moment, there is probably a 1 in 2 chance you will actually go through with that murder. If you're lucky, and the circumstance has a lot to do with this too, you'll be able to talk yourself down. If you're not so lucky? You end up like this Daniel, and letting that small moment of rage ruin a lot of lives. It's terrible.

To all of you bloggers, just for the records i have known Brandi since she was 2 years old.Yes Brandi was having an affair with her husbands Step brother, but at least she was women enough to tell him about it, Brandi had packed the childrens clothes and was waiting for them to come home from school when all this took place.Brandi was not leaving her children behind as the guy above said she was going to. All three children are with their Biological Grandmother who is 53 years old, now she has three small children to attend after. As for Danial he was a coward, why didn't he put the .22 caliber to his head and pull the trigger....Now thats a coward !!! I attended this funeral last night, I saw what Danial did to Brandi it was an open casket. Danial desrves to die.
